      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in essence, that his WD AGO Form 53-55
(Enlisted Record and Report of Separation-Honorable Discharge) be corrected
to show award of the Purple Heart (PH).

2.  The applicant states, in essence, that on 4 April 1945, his platoon was
fired upon by German Soldiers and forced to take shelter in the basement of
an old home.  He received a shrapnel wound to the arm; his platoon was
captured and moved behind enemy lines.  He was treated at a German Aid
Station.  The wound healed, he was liberated, and the war ended two weeks
later.  He realizes he should have reported that he was wounded, but he was
excited about going home.  He also failed to report the wound during
separation processing.

3.  The applicant provides in support of his request:

      a.  WD AGO Form 53-55 and Honorable Discharge Certificate.

      b.  War Claims Commission correspondence, dated between November and
October 1952 which shows the applicant was paid $17.00 in compensation in
accordance with the War Claims Act as a result of his prisoner of war (POW)
status from 4-25 April 1945.

CONSIDERATION OF EVIDENCE:

1.  The applicant is requesting correction of alleged error which occurred
on
10 February 1946.  The application submitted in this case is dated 17
August 2004.

2.  Title 10, U.S. Code, Section 1552(b), provides that applications for
correction of military records must be filed within 3 years after discovery
of the alleged error or injustice.  This provision of law allows the Army
Board for Correction of Military Records (ABCMR) to excuse failure to file
within the 3-year statute of limitation if the ABCMR determines that it
would be in the interest of justice to do so.  In this case, the ABCMR will
conduct a review of the merits of the case to determine if it would be in
the interest of justice to excuse the applicant’s failure to timely file.

3.  On 18 March 1943, the applicant was inducted into the Army of the
United States.  He was officially awarded military occupational specialty
(MOS) 060, Cook.  However, his WD AGO Form 24 (Service Record) shows as of
2 March 1945, he was serving as an Infantryman and was authorized combat
infantry pay. His final pay worksheet also shows he received combat
infantry pay at the time of separation.
4.  Headquarters, 13th Infantry Regiment, General Orders Number 26, dated
31 March 1945, awarded the applicant the CIB, effective 2 March 1945.

5.  The applicant served in a POW status from 4-25 April 1945.  On
9 February 1946, the applicant underwent a separation physical examination.
 His WD AGO Form 38 (Report of Physical Examination of Enlisted Personnel
Prior to Discharge, Release from Active Duty), Item 11 (List all Diseases,
Wounds and Injuries) shows the applicant stated that he had "No
Complaints."

6.  The applicant was honorably separated on 10 February 1946.  His WD AGO
Form 53-55 shows he served in the European-African-Middle Eastern (EAME)
Theater of operations from 18 February to 10 July 1945 during the Rhineland
and Central Europe campaigns with the 13th Infantry Regiment until he
returned to the United States.  His foreign service equals 5 months.  He
was awarded the Good Conduct Medal, EAME Campaign Medal, American Campaign
Medal, Combat Infantryman Badge, World War II Victory Medal and the
Honorable Service Lapel Button.  The PH is not shown as an authorized
award.

7.  Item 34 (Wounds Received in Action) of the applicant's WD AGO Form
53-55 states “None.”

8.  Information obtained from Hospital Admission Cards created by the
Office of The Surgeon General between 1942-1945 shows the applicant was
treated for tonsillitis in January 1944.  However, it fails to show that
the applicant was ever treated for wounds received in action.

9.  Army Regulation 600-8-22 (Military Awards) sets forth Department of the
Army criteria, policy and instructions concerning individual military
awards, the Good Conduct Medal, service medals and service ribbons, combat
and special skill badges and tabs, unit decorations, and trophies and
similar devices awarded in recognition of accomplishments.  This regulation
provides, in pertinent part, that the:

      a.  PH is awarded for a wound sustained as a result of hostile action.
 Substantiating evidence must be provided to verify that:  (1) the wound
was the result of hostile action; (2) the wound required medical treatment;
and (3) the medical treatment was made a matter of official record.  This
regulation also provides that there is no statute of limitations on
requests for award of the PH.



b.  Bronze Star Medal (BSM) is awarded for heroism and for meritorious
achievement or service in military operations against an armed enemy.  The
BSM is authorized for each individual who was cited in orders or awarded a
certificate for exemplary conduct in ground combat between 7 December 1941
and 2 September 1945 or whose achievement or service, during that period,
was confirmed by documents executed prior to 1 July 1947.  An award of the
CIB or the Combat Medical Badge is considered to be a citation in orders.
This means, in effect, that the BSM is to be awarded to individuals who
were authorized either badge for service during World War II.

      c.  Bronze service star award is authorized based on qualifying
service, for each campaign listed in Appendix B of this regulation and
states that authorized bronze service stars will be worn on the appropriate
service medal.  The applicant is authorized award of two bronze service
stars to represent the campaigns in which he participated between 18
February and 10 July 1945.


      d.  POW Medal was authorized on 8 November 1985 and is awarded to
individuals who, in past armed conflicts, were taken prisoner or held
captive.


DISCUSSION AND CONCLUSIONS:

1.  The available evidence available does not support that the applicant's
hernia was the result of combat action.  To be awarded the PH, the
applicant would have to show he was wounded and that:  (1) the wound was
the result of hostile action; (2) the wound required medical treatment; and
(3) the medical treatment was made a matter of official record.  The
applicant has acknowledged that he failed to report that he was wounded
upon repatriation and then again at the time of separation from active
duty.  If the applicant was wounded at the time of his capture, he had the
responsibility to report that he was wounded at the time of liberation or
at the time of separation.  His personal statement created almost
50 years after the fact is not substantiating proof to establish a basis
for award of the PH.

2.  The available evidence supports that the applicant served in a POW
status from 4-25 April 1945.  Therefore, he is authorized award of the POW
Medal.

3.  Based on award of the CIB, the applicant is authorized award of the
BSM.  He is also authorized award of two bronze service stars to be worn on
the EAME Campaign Medal to represent the two campaigns in which he
participated between 18 February and 10 July 1945.

4.  It would be appropriate to correct the applicant's WD AGO Form 53-55 to
show the above awards.

1.  The Board determined that the evidence presented was sufficient to
warrant a recommendation for partial relief and to excuse failure to timely
file.  Although the applicant did not file within the ABCMR's statute of
limitations, it is appropriate to waive failure to timely file based on the
fact there is no statute of limitations on requests for award of the PH.
As a result, the Board recommends that all Department of the Army records
of the individual concerned be corrected by showing he is authorized award
of the POW Medal, BSM, and two bronze service stars to be worn on the EAME
Campaign Medal.

2.  The Board further determined that the evidence presented is
insufficient to warrant a portion of the requested relief.  As a result,
the Board recommends denial of award of the PH.
