The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that she be awarded an additional 2 years of
constructive service credit.
2. The applicant states that her DA Form 5074-4R (Record of Award of Entry
Grade Credit (Medical and Dental Officers)) does not include her Master's
Degree in Public Health awarded in June 2003. It should be amended to
include 2 years of credit for 2 years of that schooling. Army Regulation
135-101 states that 1 year credit should be given for each year of advanced
education, and a degree in Public Health is one of the qualifying
additional degrees. Her Master's in Public Health is adjunctive to her
original medical degree and is helpful in her current career duties at a
major medical center for teaching, ongoing research, and mentoring.
3. The applicant provides her DA Form 5074-4R; a DD Form 214 (Certificate
of Release or Discharge from Active Duty); active duty orders with
amendment; and college transcripts.
CONSIDERATION OF EVIDENCE:
1. The applicant initially served on active duty as Medical Corps captain
(specialty 60P, Pediatrician) until she was discharged on 30 June 2000.
She was appointed a captain in the U. S. Army Reserve on 1 July 2000.
2. The applicant apparently attended Fellowship training in Pediatrics
Rheumatology from 1 July 2000 through 30 June 2003. She attended graduate
school at the University of Washington from autumn 2001 in a special
program (staff/faculty exempt) until she earned a Master of Science Degree
in Public Health – Epidemiolgy on 13 June 2003.
3. On 1 July 2003, the applicant was ordered to active duty as a Medical
Corps major. She was awarded 4 years of constructive credit for her basic
degree; 1 year of constructive credit for her internship; 2 years of
constructive credit for graduate professional education in Pediatrics; 3
years of constructive credit for graduate professional education
(Fellowship training) in Pediatrics Rheumatology; and 2 years, 1 month, and
10 days of constructive credit for her prior service (her total prior
service minus the overlap with her internship and graduate professional
education in Pediatrics constructive credit) for a total of 12 years, 1
month, and 10 days of constructive credit.
4. In the processing of this case, an advisory opinion was obtained from
the Graduate Medical Education Division, Office of The Surgeon General.
That office noted that Department of Defense Instruction (DODI) Number
6000.13 is the governing directive in granting entry grade credit. In
accordance with this directive, a period of time shall be counted only once
when computing entry grade credit. The applicant was in her Fellowship
training program at the same time that her Master's degree was awarded.
She was awarded three years of entry grade credit for her Fellowship
training program and she cannot receive credit twice for the same period of
time.
5. DODI 6000.13 (Medical Manpower and Personnel) implements policy,
assigns responsibilities, and prescribes procedures to carry out medical
manpower and personnel programs. Paragraph 6.1 states that the entry grade
credit to be awarded shall equal the sum of constructive service credit and
prior commissioned service (as outlined in the DODI) credit except in cases
where the total exceeds the maximum credit allowed. A period of time shall
be counted only once when computing entry grade credit.
6. A copy of the advisory opinion was provided to the applicant for
comment or rebuttal. She did not respond within the given time frame.
DISCUSSION AND CONCLUSIONS:
1. The applicant's reference to Army Regulation 135-101 is noted; however,
DODI 6000.13 takes precedence over that regulation.
2. It appears the applicant was attending graduate school to earn her
Master of Science Degree in Public Health at the same time she was in
Fellowship training. She has been awarded constructive service credit for
that Fellowship training, training that completely overlaps the period she
was attending graduate school. DODI 6000.13 is clear – a period of time
shall be counted only once when computing entry grade credit. Therefore,
she is not eligible to receive the additional 2 years of constructive
service credit.

BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable
error or injustice. Therefore, the Board determined that the overall
merits of this case are insufficient as a basis for correction of the
records of the individual concerned.
