      The applicant and counsel if any, did not appear before the Board.

      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that the records of her deceased
former spouse, a former service member (FSM), be corrected to show he
changed his Survivor Benefit Plan (SBP) coverage to former spouse coverage.

2.  The applicant states that she was married to the FSM for 24 years.

3.  The applicant provides the FSM's death certificate; their marriage
certificate; the FSM's last will and testament dated 10 November 1983;
email correspondence with the Defense Finance and Accounting Service
(DFAS); and the divorce decree.

CONSIDERATION OF EVIDENCE:

1.  The FSM was inducted into the Army on 14 August 1961.  He and the
applicant married on 20 August 1975.  He retired on 1 November 1989.  At
that time, he enrolled in the SBP for spouse only coverage, reduced base
amount.

2.  On 8 November 1995, the FSM filed for divorce in the Civil District
Court for the Parish of Orleans, State of Louisiana.  The available divorce
decree awarded the applicant alimony and the FSM was ordered to keep her as
the beneficiary of two life insurance policies.  The SBP was not mentioned.
 The available divorce decree is not signed by a judge.

3.  The FSM died on 8 January 2002.  His death certificate shows he was
divorced.

4.  Records at DFAS show that the FSM continued to pay SBP premiums until
his death but no one is currently receiving the SBP annuity.

5.  Public Law 92-425, the SBP, enacted 21 September 1972, provided that
military members could elect to have their retired pay reduced to provide
for an annuity after death to surviving dependents.

6.  Public Law 97-252, the Uniformed Services Former Spouses Protection Act
(USFSPA), dated 8 September 1982, established SBP coverage for former
spouses of retiring members.

7.  Public Law 98-94, dated 24 September 1983, established former spouse
coverage for retired members (Reservists, too).

8.  Public Law 99-661, dated 14 November 1986, permitted divorce courts to
order SBP coverage (without the member’s agreement) in those cases where
the member was participating in the SBP or was still on active duty and had
not yet made an SBP election.

DISCUSSION AND CONCLUSIONS:

It appears the FSM and the applicant divorced in 1995.  Although the
available divorce decree does not mention the SBP, records at DFAS show
that the FSM continued to pay SBP premiums until he died, indicating that
it may have been his intent to continue to provide the SBP for the
applicant.  His death certificate shows his marital status as divorced and
the SBP annuity is not currently being paid to anyone.  As a matter of
equity, the applicant should be granted the SBP annuity.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief.  As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by:

     a.  showing that the FSM requested after his divorce, in a timely
manner as required by law, to change his SBP coverage from spouse to former
spouse coverage; and

     b.  that the applicant be paid the SBP annuity as the former spouse
retroactive to the date of the FSM's death.
