RECORD OF PROCEEDINGS
IN THE CASE OF:
BOARD DATE: 13 January 2005
DOCKET NUMBER: AR20040000105
I certify that hereinafter is recorded the true and complete record
of the proceedings of the Army Board for Correction of Military Records in
the case of the above-named individual.
| |Mr. Carl W. S. Chun | |Director |
| |Mr. W. W. Osborn, Jr. | |Analyst |
The following members, a quorum, were present:
| |Mr. Walter T. Morrison | |Chairperson |
| |Ms. Eloise C. Prendergast | |Member |
| |Ms. Jeanette R. McCants | |Member |
The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests removal of a 7 October 1999 memorandum showing
that he was administratively removed from a sergeant first class (E-7)
promotion list because he elected not to be reclassified as a recruiter.
2. The applicant states that, while on recruiting duty he was selected for
promotion as a recruiter. He had only 9 years service at that time and did
not care to be a career recruiter. He elected not to accept
reclassification and his name was administratively removed from the
promotion list. The memorandum reflecting this incident is located on his
restricted fiche of his Official Military Personnel File (OMPF). That
document might be interpreted as being derogatory by a promotion board. He
believes that it should be removed.
3. The applicant provides a copy of the 7 October 1999 memorandum.
CONSIDERATION OF EVIDENCE:
1. The applicant, a career noncommissioned officer (NCO), was a staff
sergeant serving on recruiting duty in 1999 when he was selected for
promotion to sergeant first class as a recruiter. He declined this
promotion because he did not wish to become a career recruiter and his name
was removed from the promotion list.
2. The 7 October 1999 memorandum, which states in pertinent part, "based
on your declination of 79R reclassification, your name has been
administratively removed from the list." It is filed on the restricted
portion of his OMPF. There are no associated documents filed anywhere in
the applicants record.
3. Army Regulation 600-8-104 (Military Personnel Information
Management/Records) sets forth the policy for the maintenance of personnel
records. Table 2-1 lists the composition of the OMPF and specifies that
declination of promotion statements are to be filed in the general
administrative data section on the service fiche. Documents that reflect
approved removal from promotion lists are to be filed in the restricted
portion along with all associated documents.
DISCUSSION AND CONCLUSIONS:
1. Although there are no associated documents filed in the OMPF the
subject document is sufficiently clear, in and of itself, to accurately
reflect what happened in this case.
2. The subject document is properly filed in accordance with the governing
regulation.
3. The applicant has provided no evidence or convincing argument to show
that the subject document could or would be interpreted as being unduly
prejudicial. Indeed, a record of what happened in this instance is
conceivably less prejudicial than no evidence relating to the promotion
history of a career NCO who might normally be expected to be serving in a
higher rank.
BOARD VOTE:
________ ________ ________ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
__wtm___ _ecp____ __jrm____ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable
error or injustice. Therefore, the Board determined that the overall
merits of this case are insufficient as a basis for correction of the
records of the individual concerned.

The applicant requests removal of the U.S. Total Army Personnel Command memorandum, dated 8 November 2001, subject: Administrative Removal from the Promotion Selection List, from his Official Military Personnel File (OMPF). The applicant states: * the memorandum misrepresents his service and may be seen as a negative action by future promotion, qualitative service program, or qualitative management boards that could potentially end his military service erroneously * he joined the Army in...

He states that future selection board members may see that he refused promotion to the pay grade of E-7 in the past and question why he should be promoted again. According to the Chief, Enlisted Promotions, Promotions Branch, United States Total Army Personnel Command, the applicant was considered and selected for promotion by the Sergeant First Class and Advanced Noncommissioned Officer Selection Board. Promotion boards for selection to the pay grades of E-7 and E-8 are not routinely...

The appeal correspondence was directed to be placed in the applicant’s restricted fiche, and stated that promotion consideration was not applicable. Once placed in the OMPF, the document becomes a permanent part of that file and will not be removed from a fiche or moved to another part of the fiche unless directed by certain agencies, to include the Army Board for Correction of Military Records (ABCMR). The applicant's contention that the NCOER, even as corrected, would be damaging to her...

The applicant requests that the summary of MOS (Military Occupational Specialty)/Medical Retention Board (MMRB) Proceedings contained in the performance fiche of her OMPF (Official Military Personnel File) be transferred to the restricted fiche of her OMPF. The MMRB determined that she was fully capable of performing her duties. She feels that the MMRB documents contained in her performance fiche prejudice her promotion to master sergeant, in that promotion board members would presume that...

APPLICANT REQUESTS: That her 18 November 1986 nonjudicial punishment (NJP) imposed under Article 15, Uniform Code of Military Justice (UCMJ) and her removal as a Drill Sergeant Candidate, filed on the restricted (R) fiche of her Official Military Personnel File (OMPF), be expunged from her records. In support of her case, she submits a physician's recommendation for her return to Drill Sergeant Duty, a reinstatement authorization for the Drill Sergeant Program and orders awarding her...

The applicant requests that the 26 August 1991 memorandum showing that he was disqualified for award of the Good Conduct Medal during his first period of service be removed from his performance fiche. THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. Supporting statement from the applicant’s current battalion commander, dated 15 December 2005, recommends approval of his request for removal of the GOMOR. The applicant’s company commander and battalion commander recommended that the GOMOR be filed in the applicant’s local file but, the brigade commander disagreed with their recommendation.
ARMY | BCMR | CY2004 | 20040000318C070208
The applicant requests that a record of nonjudicial punishment (Article 15) and a service school academic evaluation report (AER) be expunged from his OMPF (Official Military Personnel File). Once placed in the OMPF, the document becomes a permanent part of that file and will not be removed from a fiche or moved to another part of the fiche unless directed by certain agencies, to include the Army Board for Correction of Military Records (ABCMR). There is no injustice in maintaining the...

Counsel requests the applicant be reinstated in the Drill Sergeant (DS) Program and all related documents, including her letter of reprimand (LOR), letter of removal from the DS Program, and relief-for-cause noncommissioned officer evaluation report (NCOER), be removed from her official military personnel file (OMPF) or moved to the restricted fiche. c. The applicant's LOR and removal from the DS Program were false and unjust. The evidence of record confirms the applicant was involved in a...

The applicant requests, in effect, that the Memorandum, dated 6 June 2002, from the U.S. Total Army Personnel Command (PERSCOM) be removed from his Restricted Fiche of his Official Military Personnel File (OMPF). Therefore, the Board recommends that the Memorandum, dated 6 June 2002, which contains the words "declination of continued service" be expunged from the applicant's Restricted Fiche of his OMPF. The Board now recommends that the Memorandum, dated 6 June 2002, which contains the...
