The Board considered the following evidence:
Exhibit A - Application for correction of military records.
Exhibit B - Military Personnel Records (including advisory opinion,
if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his record be corrected to show award of
the Global War On Terrorism Service Medal (GWOTSM), Global War On Terrorism
Expeditionary Medal (GWOTEM), the Army Commendation Medal, and the Army
Achievement Medal.
2. The applicant states that he earned those awards while serving in
Afghanistan from 26 June 2002 to 7 November 2002.
3. The applicant provides a copy of his DD Form 214 (Certificate of
Release or Discharge from Active Duty), a copy of an approved award
recommendation for the Army Commendation Medal, and a copy of an approved
award recommendation for the Army Achievement Medal.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the Army for 4 years on 3 April 2000,
completed training, and in June 2000 was assigned to Fort Bragg, North
Carolina. An NCOER (Noncommissioned Officer Evaluation Report) for the
period July 2002 through December 2002 shows that he was assigned to
Company D, 327th Signal Battalion (Airborne) at Bagram Air Base in
Afghanistan. His report for the period January 2003 through December 2003
shows that he was assigned to Company C of the above-mentioned battalion at
Fort Bragg, North Carolina, and that one of his duties was the preparation
and execution of Operation Enduring Freedom rotation.
2. The applicant was awarded the Army Commendation Medal for meritorious
service for the period 7 July 2000 to 2 April 2004. That award is not
reflected on his DD Form 214.
3. The approved award recommendation for the Army Achiement Medal that the
applicant submits with his request is for meritorious achievement while a
member of the 340th Forward Support Battalion, a unit of the California
Army National Guard. The award is indicated for the period 1 August 2003
to 19 October 2004. The proposed citation reads in part, “For outstanding
performance of duty during AT-05, annual training 2005, Camp Roberts.” The
recommendation for the award was approved on 20 October 2004.
4. On 9 February 2004, prior to his release from active duty, the
applicant enlisted in the Army National Guard for 3 years, 11 months, and
24 days.
5. The applicant was released from active duty on 2 April 2004 and
transferred to a unit of the 340th Support Battalion, a National Guard unit
in California. His DD Form 214 shows that he served in Operation Enduring
Freedom in Afghanistan from 26 June 2002 to 7 November 2002.
6. The Global War on Terrorism Service Medal is designated for Soldiers
who have participated in or served in support of Global War on Terrorism
Operations outside of the designated area of eligibility determined for
award of the Global War on Terrorism Expeditionary Medal on or after 11
September 2001 to a date to be determined. All Soldiers on active duty on
or after 11 September 2001 having served 30 consecutive days or 60
nonconsecutive days are authorized this award.
7. The Global War on Terrorism Expeditionary Medal is designated for
Soldiers who deploy abroad for service in the Global War on Terrorism
Operations on or after 11 September 2001 to a date to be determined.
Soldiers who deployed abroad in Operations Enduring Freedom and Iraqi
Freedom are eligible for this award.
8. The Afghanistan Campaign Medal is authorized for service in direct
support of Operation Enduring Freedom on or after 24 October 2001 to a
future date to be determined. Effective 30 April 2005 the Global War on
Terrorism Expeditionary Medal is no longer authorized for service in
Afghanistan. However, service members who qualified for award of the
GWOTEM in an area for which the Afghanistan Campaign Medal was subsequently
authorized shall remain qualified for the GWOTEM. Upon application, any
such service member may be awarded the Afghanistan Campaign Medal in lieu
of the GWOTEM for such service; however, no service member shall be
entitled to award of both medals for the same act, achievement, or period
of service.
9. The applicant was queried on 23 June 2005 on whether he wanted award of
the GWOTEM or the Afghanistan Campaign Medal. He requested award of the
GWOTEM.
DISCUSSION AND CONCLUSIONS:
1. The applicant met the eligibility requirements for both the GWOTEM and
the GWOTSM. He is entitled to those awards.
2. The applicant was awarded the Army Commendation Medal. His record
should reflect that award.
3. The applicant’s award of the Army Achievement Medal was for his
achievement with a California Army National Guard unit subsequent to his
release from active duty. He was released from active duty on 2 April
2004. The recommendation for the award was approved on 20 October 2004,
and the award was not for his actions or accomplishments while on active
duty. His request to correct his record to show award of the Army
Achiement medal is not warranted.

BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to
warrant a recommendation for partial relief. As a result, the Board
recommends that all Department of the Army records of the individual
concerned be corrected by showing award of the Global War on Terrorism
Service Medal, Global War on Terrorism Expeditionary Medal, and Army
Commendation Medal.
2. The Board further determined that the evidence presented is
insufficient to warrant a portion of the requested relief. As a result,
the Board recommends denial of so much of the application that pertains to
correcting his record to show award of the Army Achievement Medal.
