THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that the Personnel Electronic Record Management System (PERMS) be updated with his DA Form 1059 (Service School Academic Evaluation Report) for the Captains Career Course RC-503-02 Phase 4, his current officer evaluation report (OER) for the period 21 October 2002 through 28 March 2003, and his transcript for civilian education from Southwest University indicating a Bachelor of Science Degree in Criminal Justice, graduation date November 1999.
2. The applicant states that the PERMS is not up-to-date or personnel are not submitting information to be input into the system.
3. The applicant provides copies of his DA Form 1059 and his Student Permanent Record from Southwest University.
CONSIDERATION OF EVIDENCE:
1. The applicant's military records show that he was appointed in the Reserve as a second lieutenant effective 8 August 1992.
2. The applicant was promoted to first lieutenant effective 21 August 1995 and to captain 21 August 2000. His date of rank was subsequently adjusted to 20 August 1999 under the Reserve Officer Personnel Management Act Project.
3. The applicant's Officer Record Brief dated 23 May 2000 shows he received a Bachelor of Science Degree in Criminal Justice from Southwest University in 1999 and his last OER was for the period ending 26 September 1999.
4. The applicant completed the Military Intelligence (MI) Captains Career Course RC-503-2 Phase 4 effective 27 September 2002.
5. The applicant's records also show that he received a release from active duty officer evaluation report for the period 21 October 2002 through 28 March 2003.
6. In a memorandum to the Army Review Boards Agency, dated 26 June 2003, a staff member of the Human Resources, 63rd Regional Support Team advised that the applicant's DA Form 1059 for the MI Captains Career Course RC-503-02 Phase 4 and current OER for the period ending 28 March 2003 have been updated on PERMS. However, a staff member of the PERMS Maintenance Division, Army Reserve Personnel Command, advised that an Army Board for Correction of Military Records recommendation/ruling is required for priority updating of PERMS with the applicant's transcript from Southwest University.
DISCUSSION AND CONCLUSIONS:
1. In view of the circumstances in this case, the PERMS should be updated to include the applicant's transcript from Southwest University indicating a Bachelor of Science Degree in Criminal Justice, graduation date November 1999. The evidence of record confirms that the PERMS has not been timely updated with this record.
2. In view of the foregoing, the applicant’s records should be corrected as recommended below.
