         The Board, established pursuant to authority contained in 10 U.S.C. 1552, convened at the call of the Chairperson on the above date. In accordance with Army Regulation 15-185, the application and the available military records pertinent to the corrective action requested were reviewed to determine whether to authorize a formal hearing, recommend that the records be corrected without a formal hearing, or to deny the application without a formal hearing if it is determined that insufficient relevant evidence has been presented to demonstrate the existence of probable material error or injustice.

         The applicant requests correction of military records as stated in the application to the Board and as restated herein.

         The Board considered the following evidence:

APPLICANT REQUESTS: In effect, that Item 12 (Last Duty Assignment and Major Command) be changed to "Hq Btry 1st Bn 17th Arty."

APPLICANT STATES: The applicant neither makes a statement nor does he introduce an argument in support of his request. The applicant submitted no documentary evidence to support his contention.

EVIDENCE OF RECORD: The applicant's military records show:

The applicant was inducted into the Army of the United States for 2 years on 14 July 1961. He successfully completed basic combat training at Fort Benning, Georgia. He was trained and awarded the military occupational specialty 310.00 (Field Communications Crewman).

The applicant's DA Form 24, Service Record, shows that he was initially assigned, on 20 July 1961, to B Battery, 7th Howitzer Battalion, 17th Artillery, Fort Benning, Georgia, but on 8 December 1961 he was assigned to B Battery, 1st Rocket Howitzer Battalion, 12th Artillery, Fort Benning. He remained with that battalion for nearly 20 months of his overall service time.

The applicant was released from active duty on 1 August 1963 in the rank and pay grade, Private First Class, E-3, with an honorable characterization of service. On his release date, the applicant had 2 years active Federal service.

Item 12 of the applicant's DD Form 214, shows that, on the day of his separation, he was assigned to Headquarters Battery, 1st Battalion, 15th Artillery, 3rd US Army.

On 15 May 1974, the applicant reported that Item 12 was incorrect and requested that the records custodian change Item 12 of his DD Form 214 to show the 12th Artillery.

On 13 June 1974, a DD Form 215, Correction to DD Form 214, Report of Separation from Active Duty, was prepared. This DD Form 215 changed Item 12 for Headquarters Battery, 1st Battalion, 15th Artillery, 3rd US Army to Headquarters Battery, 1st Battalion, 12th Artillery, 3rd US Army.

DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:


1. The correction made to the applicant's DD Form 214 on 13 June 1974 in
response to his request is correct and no further correction is necessary.

2. In view of the foregoing, there is no basis for granting the applicant's request.

DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
