         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that the "discharge certificate" that was issued to her deceased husband, a former service member (FSM), be corrected to show the correct spelling of his last name.

3. The applicant further states that the sixth letter of her husband's last name is an "R' and that the discharge document shows the sixth letter of his last name as an "E".

4. In support of the application, the applicant provided a Certificate of Death for the FSM.

5. The applicant also provided a NA Form 13038 (Certificate of Military Service) issued on 28 April 1998 to the FSM.

6. The FSM's military records have been lost or destroyed. This case is being considered using reconstructed records.

7. The FSM's reconstructed records consist primarily of DA Forms 2139 (Military Pay Voucher) for the period 1 January 1959 through 28 May 1959, and DA Forms 113 (Military Pay Record) for the period 4 June 1956 through 30 June 1958.

8. The FSM's reconstructed records show the sixth letter of his last name as an "R."

9. The FSM's discharge document shows the sixth letter of the his last name as an "E."

CONCLUSIONS:

1. The Board considered the applicant's contention that her husband's name is incorrect on his discharge document.

2. The Board noted that the FSM's records show that the sixth letter of his last name is an "R."

3. Based on the foregoing, the Board determined that the FSM's records should be corrected to show that the sixth letter of his last name is an "R."

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.




RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by showing that the sixth letter of the FSM's last name be corrected to show "R."

2. That the applicant be issued a DD Form 303a (Certificate in Lieu of Lost or Destroyed Discharge) for her late husband.
