         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military records.

         Exhibit B - Military Personnel Records (including advisory opinion, if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests a reconsideration of his previous request for correction of his records to show that he was awarded the Presidential Unit Citation.

2. The applicant states he is entitled to the Presidential Unit Citation based on the award of the Presidential Unit Citation to the entire 96th Infantry Division in 2001.

3. The applicant provides a copy of a Presidential Unit Citation certificate that has an issue date of 10 January 2001 and a 28 April 1945 Battle Casualty report which was not previously available to the Board.

CONSIDERATION OF EVIDENCE:

1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR2002080059, on 13 March 2003.

2. As noted in the prior consideration, the applicant’s military records were destroyed or lost during the National Personnel Records Center fire of 1973. Records available to the Board were obtained from alternate sources.

3. The applicant entered active duty on 13 August 1943. He served with Company E, 382nd Infantry Regiment, 96th Infantry Division from 8 May 1944 through 27 December 1945. He was honorably discharged on 19 January 1946.

4. The applicant was wounded on 6 April 1945 and hospitalized at the 147th General Hospital until 27June 1945.

5. Department of the Army Pamphlet 672-1 shows that Company E, 382nd Infantry Regiment, 96th Infantry Division was cited for the Distinguished Unit Citation (now known as the Presidential Unit Citation) for actions during the period 16 to 19 May 1945.

6. On 31 December 2001 the Department of the Army issued General Orders 29 awarding the 96th Infantry Division and all of its component parts the Presidential Unit Citation. The period covered is 1 April 1945 through 30 June 1945.

DISCUSSION AND CONCLUSIONS:

1. The applicant was in the hospital at the time that Company E, 382nd Infantry Regiment earned the Presidential Unit Citation.
2. Company E of the 382nd Infantry Regiment was a component part of the 96th Division during the period that the entire Division was awarded Presidential Unit Citation.

3. The applicant was assigned to a component of the 96th Infantry Division and served in the actions for during the period the division was authorized the Presidential Unit Citation.

4. Therefore, the applicant is entitled to award of the Presidential Unit Citation, based on the Division’s awarded of the Presidential Unit Citation..

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR2002080059, dated 13 March 2003. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected to show he is authorized the Presidential Unit Citation.
