APPLICANT REQUESTS: Correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show award of the Armed Forces Expeditionary Medal and issuance of medals to which he is entitled.
APPLICANT STATES: That he never received any of his medals when he was discharged. He states that only the Good Conduct Medal and the Expert Marksmanship Qualification Badge are shown on his DD Form 214 but the Armed Forces Expeditionary Medal is not listed. He states that he was shipped to Lebanon from Munich, Germany in June 1958. He claims that he served in Lebanon from 1 July 1958 to 1 November 1958 and then returned to Germany. His company was the 22nd Ordnance Company and the Armed Forces Expeditionary Medal was authorized for Lebanon after he was discharged. In support of his application, he submitted a copy of his DD Form 214.
EVIDENCE OF RECORD: The applicant's military records have been lost or destroyed. This case is being considered using reconstructed records. The applicant's reconstructed records consist primarily of his DD Form 214, copies of DA Form 1 (Morning Report) and a DA Form 1577 (Authorization for Issuance of Awards).
The applicant's reconstructed records show he was inducted into the Army on 4 January 1957. He completed the required training and was awarded specialty number 635.10 (Auto Repairman). He was released from active duty on 24 December 1958.
The applicant's DD Form 214 shows entitlement to the Good Conduct Medal and the Expert Marksmanship Qualification Badge.
Item 24c (Foreign and/or Sea Service) on the applicant's DD Form 214 shows he completed 1 year, 3 months, and 19 days of foreign service. His discharge document shows his last duty assignment and major command as the 22nd Ordnance Company.
The available records contain a Monthly Personnel Roster for the month of July 1958 which verifies the applicant was assigned to the 22nd Ordnance Company as of July 1958.
The available records contain a Morning Report which shows that the 22nd Ordnance Company departed from Bremerhaven, Germany on 24 July 1958. A second Morning Report shows the 22nd Ordnance Company debarked
at Beirut, Lebanon on 1 August 1958. However, the applicant's name is not listed on these Morning Reports (no by-name listing is attached).
The DA Form 1577, dated 1 June 1984 shows the applicant was authorized issuance of the Good Conduct Medal.
Army Regulation 600-8-22 (Military Awards), provides, in pertinent part, that the Armed Forces Expeditionary Medal is authorized for participants in military operations within a specific geographic area during a specified time period. Paragraph 2-12c specifically provides that individuals qualified for the Armed Forces Expeditionary Medal for service in Lebanon from 1 July 1958 and 1 November 1958.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.
2. The Board notes the applicant's contention that he served in Lebanon from 1 July 1958 to 1 November 1958 with the 22nd Ordnance Company. However, there is no evidence available to the Board which shows he was with the unit when it served a period of qualifying service in Lebanon for award of the Armed Forces Expeditionary Medal. Therefore, there is insufficient basis upon which to base award of the Armed Forces Expeditionary Medal in this case.
3. The Board notes he was authorized issuance of the Good Conduct Medal in June 1984 but not the Expert Marksmanship Qualification Badge. It would be equitable to authorize issuance of the Expert Marksmanship Qualification Badge.
4. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
NOTE: Request that the Army Review Boards Agency (ARBA), Support Division, St. Louis authorize the applicant issuance of the Expert Marksmanship Qualification Badge.
