         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected by showing he was awarded the Purple Heart.

3. The applicant states that he was wounded in action against the enemy on 26 August 1967.

4. The applicant’s military records show that he was inducted into the Army of the United States on 11 February 1967, for a period of two years.

5. He served in Vietnam from November 1966 to October 1967.

6. On 22 November 1967, the applicant was released from active duty, under the provisions of Army Regulation 635-200, for early release of overseas returnees. His DD Form 214 indicates he had 1 year, 9 months and 12 days of creditable service, and was awarded the National Defense Service Medal, the Vietnam Service Medal, the Vietnam Campaign Medal, the Air Medal, and one Overseas Bar.

7. The applicant’s file contained a copy of General Orders 144, dated 27 August 1967, awarding him the Purple Heart for wounds he received in action on 25 August 1967.

8. A review of Department of the Army Pamphlet 672-3 notes that the applicant’s unit (1st Battalion, 5th Cavalry, 1st Cavalry Division) was awarded the Republic of Vietnam Gallantry Cross Unit Citation with Palm, and participated in two designated campaign periods (Vietnam Counteroffensive Phase II, and Vietnam Counteroffensive Phase III) while he was a member of the organization. The unit awards, and two bronze service stars on his Vietnam Service Medal, denoting his campaign participation were omitted from his separation document.

CONCLUSIONS:

1. Evidence shows the applicant was awarded the Purple Heart for wounds sustained in action on 25 August 1967. His records should be corrected to reflect this award.

2. The Board notes that the applicant is entitled to the Republic of Vietnam Gallantry Cross Unit Citation with Palm, and two bronze service stars on his Vietnam Service Medal.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.



RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected:

a. by showing the applicant was awarded the Purple Heart for wounds he received on 25 August 1967, and

b. by showing he is entitled to the Republic of Vietnam Gallantry Cross Unit Citation with Palm, and two bronze service stars on his Vietnam Service Medal.
