         The Board, established pursuant to authority contained in 10 U.S.C. 1552, convened at the call of the Chairperson on the above date. In accordance with Army Regulation 15-185, the application and the available military records pertinent to the corrective action requested were reviewed to determine whether to authorize a formal hearing, recommend that the records be corrected without a formal hearing, or to deny the application without a formal hearing if it is determined that insufficient relevant evidence has been presented to demonstrate the existence of probable material error or injustice.

         The applicant requests correction of military records as stated in the application to the Board and as restated herein.

         The Board considered the following evidence:

APPLICANT REQUESTS: In effect, correction of his Honorable Discharge Certificate to show he was discharged on 5 March 1946.

APPLICANT STATES: That the data shown on his Honorable Discharge Certificate is incorrect. He was not in the Army between 1946 and 1949: he was working and going to school.

In support of his application, he submitted a supplemental letter; his Honorable Discharge Certificate; Headquarters, 25th Replacement Depot, Office of the Commanding Officer, Europe Special Orders Number 15, dated 17 January 1946; a Western Union telegram; and his high school diploma of graduation.

EVIDENCE OF RECORD: The applicant's military records have been lost or destroyed. This case is being considered using reconstructed records. His reconstructed records consist primarily of his WD AGO Form 53-55 (Enlisted Record and Report of Separation), his WD AGO Form 100 (Separation Qualification Record), and limited medical records.

The applicant's reconstructed records show he was inducted into the Army of the United States on 15 September 1942 and entered active duty on 29 September 1942. He served in the Asiatic-Pacific Theater of Operations from 19 May 1945 through 20 January 1946. The applicant was honorably separated from active duty on 5 March 1946.

Block 7 (Date of Separation) on the applicant's WD AGO Form 100 shows he was separated on 5 March 1946.

The applicant provided a copy of his Honorable Discharge Certificate which shows he enlisted in the Enlisted Reserve Corps (ERC) on 5 March 1946 and was honorably discharged from the ERC on 4 March 1949.

DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:

1. The applicant's WD AGO Form 53-55 shows he was separated from the Army of the United States on 5 March 1946.

2. The Honorable Discharge Certificate provided by the applicant shows he enlisted in the ERC subsequent to his separation from active duty on 5 March 1946 and that he was discharged on 4 March 1949 as a member of the ERC.

3. In the absence of evidence to the contrary, it is presumed his Honorable Discharge Certificate accurately reflects the applicant's military status between March 1946 and March 1949. Assignment to the ERC would not necessarily preclude his work or schooling in the civilian community. Therefore, there is no basis for amending the applicant's Honorable Discharge Certificate.

4. In view of the foregoing, there is no basis for granting the applicant's request.

DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
