APPLICANT REQUESTS: Correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show award of the Combat Infantryman Badge.
APPLICANT STATES: That his DD Form 214 is missing a Combat Infantryman Badge for combat against enemy forces. He claims that he served with a combat "Recon" unit, 1st Battalion, 12th Infantry, in Vietnam for three months even though his military occupational specialty (MOS) was different than 11B20. He submitted a copy of his DD Form 214 in support of his application.
EVIDENCE OF RECORD: The applicant's military records show:
He was inducted into the Army on 23 April 1969. He was awarded primary MOS 76Y (Unit and Organization Supply Specialist) on 5 September 1969.
The applicant served in Vietnam from 10 October 1970 through 13 April 1971. His DA Form 20 (Enlisted Qualification Record) shows he was assigned to Headquarters and Headquarters Company, 4th Infantry Division and performed duties as a general supply specialist in duty MOS 76Y during his assignment in Vietnam.
Army Regulation 600-8-22 prescribes Army policy and procedures concerning awards. Paragraph 8-6 provides for award of the Combat Infantryman Badge. That paragraph states that there are basically three requirements for award of the Combat Infantryman Badge. The soldier must be an infantryman satisfactorily performing infantry duties, he must be assigned to an infantry unit during such time as the unit is engaged in active ground combat, and he must actively participate in such ground combat. Specific requirements state, in effect, that an Army enlisted soldier must have an infantry or special forces specialty, satisfactorily performed duty while assigned or attached as a member of an infantry, ranger or special forces unit of brigade, regimental, or smaller size during any period such unit was engaged in active ground combat.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.
2. There is no evidence of record which shows the applicant was awarded an infantry MOS or that he performed infantry duties with the 1st Battalion, 12th Infantry during his assignment in Vietnam. Therefore, there is insufficient evidence upon which to base award of the Combat Infantryman Badge in this case.
3. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
