THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his records be corrected to show that he enlisted for a period of 6 years vice 4 years.
2. The applicant states his term of enlistment in item 8 of his Department of Defense Form 4/1 (Enlistment/Reenlistment Document Armed Forces of the United States) should reflect 6 years and not 4 years. He notes that with the correction he will be able to receive his $16,000 cash enlistment bonus.
3. The applicant provides a copy of his enlistment contract in support of his request.
CONSIDERATION OF EVIDENCE:
1. Records available to the Board show that the applicant enlisted in the United States Army on 22 January 2002 for a period of 6 years. Included in his enlistment contract was an entitlement to a $16,000 cash enlistment bonus based on his 6-year enlistment.
2. However, item 8 of the Department of Defense Form 4/1 reflects an incorrect term of service of 4 years. His 6-year enlistment is confirmed on all of his other enlistment documents.
3. In the processing of this case an advisory opinion was provided by the Chief, Policy and Eligibility Inquiries Branch of the United States Army Human Resources Command-Alexandria, formerly known as the United State Total Army Personnel Command. The opinion noted that the applicant did enlist for a period of 6 years and that his “contract was erroneous due to Guidance Counselor error in not properly annotating the correct term of service” in item 8 of the applicant’s Department of Defense Form 4/1. They recommended that the applicant’s enlistment period be corrected and that he receive payment of his cash enlistment bonus.
4. The applicant was provided a copy of the advisory opinion and concurred with the recommendation to correct his record.
DISCUSSION AND CONCLUSIONS:
1. The evidence of record confirms that the applicant enlisted in the Regular Army for a period of 6 years vice 4 years, and item 8 of his DD Form 4/1 should be corrected accordingly.
2. With the correction of his enlistment document he will be entitled to receive the cash enlistment bonus included as part of his enlistment contract.
