         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to show two awards of the Purple Heart.

3. The applicant states that he was wounded on two occasions in Vietnam.

4. The applicant’s military records show that the applicant, then a captain, served in Vietnam from June 1967 through June 1968 with the 1st Battalion, 27th Infantry of the 25th Infantry Division. He participated in two campaigns during his tour in Vietnam and the 1st of the 27th was awarded the Republic of Vietnam Gallantry Cross Unit Citation with Palm (shown on the applicant's DD Form 214), and the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation (not reflected on his DD Form 214).

5. On 22 October 1967, Headquarters, 25th Infantry Division awarded the applicant the Purple Heart for wounds received in action on 15 September 1967. On 31 October 1967, the 12th Evacuation Hospital awarded the applicant the Purple Heart for wounds received in action on 29 October 1967. Only one award of the Purple Heart is shown on his DD Form 214.

6. On 8 December 1967, Headquarters, 25th Infantry Division awarded the applicant the Army Commendation Medal for meritorious achievement for the period 10 August 1967; and on 17 March 1968, the Army Commendation Medal with "V" device for heroism on 12 December 1967. On 1 July 1970, the Army Engineer Training Center and Fort Leonard Wood awarded the applicant the Army Commendation Medal for meritorious service for the period August 1968 to June 1970. The latter award is not reflected on his DD Form 214.

7. The applicant was released from active duty on 28 June 1973.

CONCLUSIONS:

1. The applicant was awarded the Purple Heart on two occasions for the wounds that he received in action in Vietnam. Both awards should be reflected on his DD Form 214.

2. The applicant was awarded the Army Commendation Medal on two occasions and the Army Commendation Medal with "V" device on one occasion. These awards should be shown on his DD Form 214.

3. He participated in two campaigns during his tour in Vietnam. His DD Form 214 should show award of the Vietnam Service Medal with two bronze service stars (one for each campaign).

4. He is entitled to award of the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation. That award should be reflected on his DD Form 214.
5. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned received two awards of the Purple Heart, two awards of the Army Commendation Medal and one award of the Army Commendation Medal with "V" device, the Vietnam Service Medal with two bronze service stars, and the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation.
