         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that his reenlistment contract dated 16 November 2002 be corrected to show he reenlisted for 6 years and his reenlistment contract dated 11 January 2003 be voided.

3. The applicant makes no additional statement.

4. The applicant’s military records show that, after having had prior service in the Regular Army, he entered the U. S. Army Reserve in 1985 and has had continuous service since.

5. The applicant last reenlisted in the U. S. Army Reserve on 16 November 2002. Item 8 of his DD Form 4/1 (Enlistment/Reenlistment Document Armed Forces of the United States) fails to show the length of his reenlistment.

6. The applicant's unit apparently attempted to rectify the omission in the 16 November 2002 contract by having him execute another reenlistment contract on 11 January 2003. This contract shows he reenlisted for 6 years.

CONCLUSIONS:

1. There is an administrative error on the applicant’s DD Form 4/1 dated 16 November 2002. He reenlisted in the U. S. Army Reserve for 6 years yet item 8 of his DD Form 4/1 does not reflect his period of reenlistment. This reenlistment contract should be corrected to show he reenlisted for 6 years.

2. It appears the applicant's unit attempted to correct the error on his 16 November 2002 reenlistment contract by having him execute another contract on 11 January 2003. This contract should be voided.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That the applicant’s DD Form 4/1 dated 16 November 2002, item 8 be corrected to show he reenlisted in the U. S. Army Reserve for 6 years.


2. That the applicant's DD Form 4/1 showing he reenlisted in the U. S. Army Reserve on 11 January 2003 be voided.
