         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that his military records be corrected to show his service in military occupational specialty (MOS) 11B (Infantryman).

3. The applicant states in effect, that his last separation document (DD Form 214), dated 27 March 1970, does reflect MOS 11B (Infantryman) as his primary MOS. He claims that he was given a secondary MOS of 64A10 (Light Vehicle Driver) after receiving a permanent physical profile. In support of his application, he submits a copy of his final DD Form 214, dated 27 March 1970, award orders for the Combat Infantryman Badge (CIB), and a Medical Condition – Physical Profile Record (DA Form 8-274).

4. The applicant’s military records show that on 14 March 1968, he was inducted into the Army for a period of 2 years. He continuously served on active duty until being honorably separated on 27 March 1970, in the rank and pay grade of specialist four/E-4 (SP4/E-4).

5. The applicant’s Enlisted Qualification Record (DA Form 20) verifies, in
Item 22 (Military Occupational Specialties), that he was awarded MOS 11B on
27 June 1968, and that he held and served in that MOS until it was withdrawn on 27 May 1969, at which time he was awarded MOS 64A (Light Vehicle Driver).

6. The DD Form 214 issued to the applicant on the date of his separation,
27 March 1970, shows, in Item 23a (Specialty Number and Title), that he held and was serving in MOS 64A (Light Vehicle Driver) on that date.

7. Army Regulation 635-5, in effect at the time, prescribed the separation documents which are prepared for individuals upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparing and distributing DD Form 214 and Table 2-1 contains item by item preparation instructions for the DD Form 214. It stated, in pertinent part, that the primary MOS and title held by the member on the date of separation would be entered in Item 23a (Specialty Number and Title). The current version of this regulation provides for entering all MOSs awarded to soldiers during the active duty period in Item 11 of the DD Form 214.


CONCLUSIONS:

1. The evidence of record confirms that the applicant was awarded and served in MOS 11B from 27 June 1968 through 27 May 1969, at which time it was withdrawn and he was awarded the primary MOS of 64A (Duty Foreman).

2. Although the policy in effect at the time called for entering only the MOS held on the date of separation on the DD Form 214, current regulatory guidance allows for entering all MOS codes awarded during the period of service.

3. In the opinion of the Board, it would serve the interest of equity to honor the applicant’s request to document his service in MOS 11B. Therefore, the Board concludes it would be appropriate to add the following entry to Item 23 (Specialty Number & Title) of his DD Form 214 at this time: “11B10 INFANTRYMAN,
11 MONTHS”.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case, particularly the DD Form 214 of the individual concerned, be corrected by adding the following entry to Item 23 (Specialty Number & Title): “11B10, INFANTRYMAN, 11 MONTHS”; and by providing him a corrected separation document that reflects this change.
