         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his records to show award of the Combat Infantryman Badge.

3. The applicant states that he had a combat related military occupational specialty (MOS), was in combat, and was attached to a combat battalion. He did not submit any documents in support of his application.

4. The applicant’s military records show that he served in the Regular Army, the U.S. Army Reserve, and the Army National Guard prior to his enlistment in the Regular Army on 16 August 1969. He served in Vietnam from 21 March 1971 through 11 February 1972.

5. The applicant's DA Form 20 (Enlisted Qualification Record) shows he was assigned to Headquarters and Headquarters Company and Company E, 1st Battalion, 502nd Infantry and served in duty MOS 11F (infantry operations and intelligence specialist) during his tour in Vietnam.

6. The applicant's retirement DD Form 214 (Certificate of Release or Discharge from Active Duty), for the period ending 30 June 1980, shows, in part, entitlement to the Vietnam Service Medal and the Korean Service Medal.

7. Item 38 (Campaigns) on his DA Form 20 shows he received campaign credit for participation in the Korean Summer 1953 Campaign, the Vietnam Counteroffensive Phase VII Campaign, the Consolidation I Campaign, and the Consolidation II Campaign. His DD Form 214 for the period ending 23 June 1955 shows he was awarded the Korean Service Medal with one bronze service star.

8. Army Regulation 600-8-22 provides, in pertinent part, that the Combat Infantryman Badge is awarded to infantry officers and to enlisted and warrant officer persons who have an infantry MOS. They must have served in active ground combat while assigned or attached to an infantry unit of brigade, regimental or smaller size. The Awards Branch of the Total Army Personnel Command has advised, in similar cases, that during the Vietnam era the Combat Infantryman Badge was awarded only to enlisted individuals who held and served in MOS 11B, 11C, 11F, 11G, or 11H.

9. Army Regulation 600-8-22 (Military Awards), in pertinent part, authorizes award of a bronze service star, based on qualifying service, for each campaign listed in Appendix B of this regulation and states that authorized bronze service stars will be worn on the appropriate service medal.




CONCLUSIONS:

1. The evidence of record shows the applicant was awarded an infantry MOS and was assigned to an infantry unit during combat in Vietnam. Therefore, he is entitled to award of the Combat Infantryman Badge and correction of his records to show this badge.

2. The evidence of record shows the applicant participated in one campaign while in Korea and three campaigns during his assignment in Vietnam which are not correctly shown by award of one bronze service star on his Korean Service Medal and three bronze service stars for wear on his Vietnam Service Medal. Therefore, his retirement DD Form 214 should be corrected to show the Korean Service Medal with one bronze service star and the Vietnam Service Medal with three bronze service stars.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected to show the applicant was awarded the Combat Infantryman Badge.

2. That the applicant's DD Form 214 for the period ending 30 June 1980 be corrected by adding the Combat Infantryman Badge, the Korean Service Medal with one bronze service star, and the Vietnam Service Medal with three bronze service stars.
