         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his Purple Heart and other awards be listed on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge).

3. The applicant states that his Purple Heart and other medals were not listed on his DD Form 214. In support of his application, he submits a copy of his DD Form 214 and a copy of page 1, DA Form 20 (Enlisted Qualification Record).

4. The applicant’s military records show that he entered active duty on 10 June 1965. His records show he served in Vietnam from 30 November 1965 to 30 November 1966 in Troop C, 1st Squadron of the 9th Cavalry Regiment, 1st Cavalry Division, as an Infantryman. The applicant's DD 214 shows he was separated with temporary records and was honorably discharged from active duty on 29 May 1968.

5. The applicant's DD Form 214 with an effective date of 29 May 1968 covers his tour in Vietnam. This document shows the statement "Unknown" in item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized). No awards are listed on this document.

6. The applicant's DA Form 20 shows in Item 41 (Awards and Decorations) the following awards and award authorities:

7. There are orders in the applicant's service record which show that he was awarded the Combat Infantryman Badge, Purple Heart, and Air Medal.

8. The applicant’s DD Form 214 shows the Vietnam Service Medal as an authorized award. However, evidence of record shows the applicant participated in three campaigns (Vietnam Defense Campaign, Vietnam Counteroffensive and Vietnam Counteroffensive, Phase II) during his assignment in Vietnam which are not correctly shown by award of three bronze service stars for wear on his Vietnam Service Medal. Therefore, in accordance with the governing regulation, the applicant is entitled to the Vietnam Service Medal with three bronze service stars and correction of his DD Form 214 to show these awards.

9. Army Regulation 600-8-22, in pertinent part, authorizes award of a bronze service star, based on qualifying service, for each campaign listed in Appendix B of this regulation and states that authorized bronze service stars will be worn on the appropriate service medal.

10. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the unit awards received by units serving in Vietnam. This document shows the unit, to which the applicant was assigned, Troop C, 1st Squadron of the 9th Infantry Regiment, 1st Cavalry Division was cited for award of the Presidential Unit Citation for actions during the period 25 August 1966 to 1 October 1966 by Department of the Army General Orders Number 2, dated 1973.

CONCLUSIONS:

1. The Board considered the applicant’s request that his Purple Heart and other awards be listed on his DD Form 214 and the documents which he submitted in support of his claim. The Board also reviewed the available service personnel and medical records.

2. The Board noted that there is evidence in his service personnel records which shows that he was awarded the Parachutist Badge; Vietnam Service Medal with three bronze service stars; Combat Infantryman Badge; Purple Heart; 2nd Overseas Service Bar; National Defense Service Medal; Vietnam Campaign Medal with 60 Device and Air Medal. Therefore he is entitled to correction of his DD Form 214 to reflect these awards.

3. General Orders show the applicant is entitled to award of the Presidential Unit Citation. Therefore, he is entitled to correction of his records to show this unit award.



4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned was awarded the Parachutist Badge; Vietnam Service Medal with three bronze service stars; Combat Infantryman Badge; Purple Heart; 2nd Overseas Service Bar; National Defense Service Medal; Vietnam Campaign Medal with 60 Device, Air Medal and Presidential Unit Citation.
