         I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual. A quorum was present during the further consideration and deliberation. The findings appearing in proceedings dated 10 September 2002 were affirmed. The following additional findings, conclusions, and recommendation were adopted by the Board.

         The Board convened at the call of the Director on the above date to reconsider the conclusions and recommendation appearing in proceedings dated 10 September 2002.

         The applicant and counsel, if any, did not appear before the Board.

         The Board considered the following additional evidence:

         Exhibit C - 101st Airborne Division General Orders 1515, dated 11 February 1969.

         Exhibit D - Bronze Star Medal with "V" Device (First Oak Leaf Cluster)







THE BOARD ADDITIONALLY FINDS:

16. On 13 March 2003, the applicant's Department of Veterans Affairs counsel contacted the Army Board for Correction of Military Records (ABCMR) telephonically. Counsel did not understand why the ABCMR had not corrected the applicant's records to show award of the Bronze Star Medal. Counsel advised that he had submitted the General Orders and the award certificate for award of the Bronze Star Medal with "V" Device to the applicant as evidence in support of his 6 August 2002 application.

17. Via telefax on 13 March 2003, counsel provided a copy of 101st Airborne Division General Orders 1515, dated 11 February 1969. These General Orders awarded the Bronze Star Medal with "V" Device (First Oak Leaf Cluster) to the applicant for heroism on 5 September 1968 in Vietnam.

18. Via telefax on 13 March 2003, counsel also provided a copy of an award certificate for award of the Bronze Star Medal with "V" Device (First Oak Leaf Cluster). This award certificate shows that, on 11 February 1969, award of the Bronze Star Medal with "V" Device (First Oak Leaf Cluster) was presented to the applicant for his heroism on 5 September 1968. The certificate contains the name and Army Service Number of the applicant, and it is authenticated by the signature of the Commanding General of the 101st Airborne Division.

THE BOARD ADDITIONALLY CONCLUDES:

6. At the time of the ABCMR's 10 September 2002 decision in Docket Number AR2002075040, it was the intent of the Board to make the applicant’s record as administratively correct as it should properly have been at the time of his separation from active duty on 18 July 1969.

7. General Orders show that the applicant was awarded the Bronze Star Medal with "V" Device (First Oak Leaf Cluster) for heroism in action on 5 September 1968 in Vietnam.

8. An award certificate authenticated by the Commanding General of the 101st Airborne Division shows that, on 11 February 1969, the applicant was awarded the Bronze Star Medal with "V" Device (First Oak Leaf Cluster) for heroism in Vietnam on 5 September 1968.

9. In view of the additional factors in the applicant's case, this Board has determined that there is sufficient evidence upon which to base correction of the applicant's military records to show he was awarded the Bronze Star Medal with "V" Device (First Oak Leaf Cluster) heroism on 5 September 1968 in Vietnam.

10. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records as recommended below.
THE BOARD RECOMMENDS:

3. That all of the Department of the Army records related to this case be corrected by amending the ABCMR's recommendation appearing in the proceedings in Docket Number AR2002075040, dated 10 September 2002, to show that the individual concerned was awarded the Bronze Star Medal with "V" Device (First Oak Leaf Cluster) for heroism on 5 September 1968 in Vietnam.

4. That the DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) of the individual concerned with an effective date of 18 July 1969 be corrected to show award of the Bronze Star Medal with "V" Device (First Oak Leaf Cluster) to the applicant.
