         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his service in Korea be documented on his DD Form 214 (Certificate of Release or Discharge from Active Duty) with the separation date of 30 September 1981.

3. The applicant makes no additional statement.

4. The applicant’s military records show that he enlisted in the Regular Army on 30 June 1973. He was honorably discharged for the purpose of immediately reenlisting on 31 March 1975. He received a DD Form 214 for this period but it is not applicable to his request.

5. The applicant's DA Form 2-1 (Personnel Qualification Record) shows he served in Korea from 12 May 1976 through 10 May 1977 (11 months and 29 days). He served in Hawaii from 13 September 1977 through 29 September
1981 (2 years and 17 days).

6. The applicant was honorably discharged upon completing his required service on 30 September 1981. Item 12f of his DD Form 214 with a separation date of 30 September 1981 shows he completed 2 years and 17 days of foreign service.

7. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. The regulation in effect at the time (as does the current version) stated that the total amount of foreign service completed during the period covered in item 12c (Net Active Service this Period) would be entered in item 12f.

8. Army Regulation 600-8-22 (Military Awards) does not list any awards for service in Korea during the period of the applicant's assignment there.

CONCLUSIONS:

1. There is an error on the applicant's DD Form 214 with a separation date of 30 September 1981 regarding his foreign service. The total amount of his foreign service (in Korea and Hawaii) equaled 3 years and 6 days yet only the amount of his service in Hawaii (2 years and 17 days) is shown.

2. There was no regulatory provision at the time for identifying the location of the foreign service (as there currently is not) and no awards were authorized for service in Korea during the period of the applicant's assignment there. The foreign service that should be added to his DD Form 214 will not be specifically be identified as service in Korea.

3. In view of the foregoing, the applicant’s records should be corrected but only as recommended below.

RECOMMENDATION:

1. That item 12f of the applicant's DD Form 214 with a separation date of 30 September 1981 be amended to show he completed 3 years and 6 days of foreign service.

2. That so much of the application as is in excess of the foregoing be denied.
