         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his report of separation (DD Form 214) be corrected to reflect his second tour of duty in Bosnia during the period of 22 March 1998 through 7 August 1998 and any awards he is authorized for his service in Bosnia.

3. The applicant states he discovered the error after returning to the United States after his separation. He goes on to state that he separated from a rear detachment in Germany and his last deployment to Bosnia was not indicated on his DD Form 214. In support of his application he submits orders showing his deployment dates in support of Operation Joint Guard and a memorandum from his unit showing he was awarded the NATO Medal and the Armed Forces Service Medal (AFSM).

4. The applicant’s military records show that he enlisted in Springfield, Massachusetts, on 20 January 1994, for a period of 4 years, training as a motor transport operator and enrollment in the Army College Fund. He completed his training and was transferred to Germany. He was promoted to the pay grade of E-5 on 30 May 1997 and continued to serve until he was honorably released from active duty (REFRAD) on 19 November 1998. He had served 4 years, 10 months and 19 days of total active service.

5. His DD Form 214 issued at the time of his REFRAD shows that he served in Bosnia from 26 March 1996 to 23 December 1996 and that he was awarded the Army Achievement Medal (2nd OLC), the Good Conduct Medal, the National Defense Service Medal, the NCO Professional Development Ribbon, the Army Service Ribbon, the Overseas Service Ribbon, the Driver and Mechanic Badge (Driver w/Bar) and the NATO Medal.

6. The orders provided by the applicant show that he was deployed in support of Operation Joint Guard (Austria, Germany and Hungary) from 22 March 1998 to 7 August 1998.

CONCLUSIONS:

1. The applicant has provided sufficient evidence to show that he served in support of Operation Joint Guard during the period of 22 March to 7 August 1998. Accordingly, it would be in the interest of justice to correct his DD Form 214 to reflect such.

2. Additionally, the applicant was awarded the AFSM, which was omitted from his DD Form 214 at the time of separation. Therefore, it would be appropriate to add that award at this time as well.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION: That all of the Department of the Army records related to this case be corrected by showing that the individual concerned served in support of Operation Joint Guard from 22 March to 7 August 1998 and that he was awarded the AFSM.
