         I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual. A quorum was present during the further consideration and deliberation. The findings appearing in proceedings dated 23 July 2002 were affirmed. The following additional findings, conclusions, and recommendation were adopted by the Board.

THE BOARD ADDITIONALLY FINDS:

17. On 23 August 2002, the applicant, in effect, requested reconsideration of denial of award of the Bronze Star Medal by the Army Board for Correction of Military Records (ABCMR). In his letter, he states that he does not have a copy of the General Orders awarding him the Bronze Star Medal, but that he did provide a copy of the General Orders which amended the original orders. The applicant also states that there was no signature on the award certificate because the division commander had just been relieved as a result of Fire Base Mary Ann being overrun by enemy forces.

18. On or about 27 November 2002, an official of the Awards Branch of the U.S. Total Army Personnel Command conducted a search of unit records which revealed 23d Infantry Division General Orders Number 05253, dated 8 May 1971. These General Orders awarded the applicant the Bronze Star Medal for meritorious achievement during the period 1 October 1970 to 31 March 1971 and incorrectly showed his rank as "SERGEANT FIRST CLASS."

19. The applicant provided a copy of 23d Infantry Division General Orders 7707, dated 9 July 1971, which amended General Orders 05253 to show the applicant's rank as "SPECIALIST FOUR."

THE BOARD ADDITIONALLY CONCLUDES:

10. At the time of the ABCMR's 23 July 2002 decision in Docket Number AR2002071446, it was the intent of the Board to make the applicant’s record as administratively correct as it should properly have been at the time of his separation from active duty on 13 February 1973.

11. General Orders show that the applicant was awarded the Bronze Star Medal for meritorious achievement in Vietnam for the period 1 October 1970 to 31 March 1971.

12. In view of the additional factors in the applicant's case, this Board has determined that there is sufficient evidence upon which to base correction of his military records to show he was awarded the Bronze Star Medal for meritorious achievement for the period 1 October 1970 to 31 March 1971.

13. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records as recommended below.

THE BOARD RECOMMENDS:

3. That all of the Department of the Army records related to this case be corrected by amending the ABCMR's recommendation appearing in the proceedings in Docket Number AR2002071446, dated 23 July 2002, to show that the individual concerned was awarded the Bronze Star Medal for meritorious service in Vietnam for the period 1 October 1970 to 31 March 1971.

4. That the DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) of the individual concerned with an effective date of 13 February 1973 be corrected to show award of the Bronze Star Medal.
