MEMORANDUM OF CONSIDERATION

         IN THE CASE OF:

         BOARD DATE: 3 June 2003
         DOCKET NUMBER: AR2002082294

I certify that hereinafter is recorded the record of consideration of the Army Board for Correction of Military Records in the case of the above-named individual.

Mr. Carl W. S. Chun Director
Mr. Edmund P. Mercanti Analyst

The following members, a quorum, were present:

Ms. Joann H. Langston Chairperson
Ms. Jennifer L. Prater Member
Mr. Paul M. Smith Member

The Board, established pursuant to authority contained in 10 U.S.C. 1552, convened at the call of the Chairperson on the above date. In accordance with Army Regulation 15-185, the application and the available military records pertinent to the corrective action requested were reviewed to determine whether to authorize a formal hearing, recommend that the records be corrected without a formal hearing, or to deny the application without a formal hearing if it is determined that insufficient relevant evidence has been presented to demonstrate the existence of probable material error or injustice.

The applicant requests correction of military records as stated in the application to the Board and as restated herein.

The Board considered the following evidence:

Exhibit A - Application for correction of military
records
Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

APPLICANT REQUESTS: That the abbreviation “TNG” be deleted from items 19 and 32 on his separation document.

APPLICANT STATES: He served approximately 6 weeks as an assistant platoon leader after he completed infantry school. He has been denied Department of Veterans Affairs (DVA) medical benefits because the abbreviation for training is used to describe the nature of his service.

EVIDENCE OF RECORD: The applicant's military records show:

He was commissioned as a second lieutenant, Army Reserve, on 5 August 1955.

On 20 July 1955, orders were published for the applicant to attend Infantry Officer Basic Course.

On 26 July 1956, the applicant was given a rating for the period 1 June to 18 July 1956. His rating report indicates that he served as an assistant platoon leader during that time.

On 18 July 1956, the applicant and an authenticating officer signed a DA Form 1270, Transfer or Release to Reserve Component of the Army. On the top of this form, a block is provided to indicate whether the officer was being released from active duty or active duty for training. The block for active duty for training was marked. In Section B of this form, it was indicated that the applicant served on active duty from 19 January to 18 July 1956. It was further stated that “Having completed, or having been released prior to completion of, initial period of 6 months active duty for training, you are returned to reserve duty status . . .”

DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record and applicable law and regulations, it is concluded:

1. While the applicant may have completed his formal school training and performed duties as an assistant platoon leader, he was still in an initial active duty for training status while he was so employed. As such, his separation document is properly annotated with his training status.

2. In view of the foregoing, there is no basis for granting the applicant's request.

DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.

BOARD VOTE:
