         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. In effect, the applicant requests that his enlistment documents be corrected to reflect the correct spelling of his middle name.

3. The applicant states that his middle name is "Joseph," as shown on the certified abstract of his birth certificate issued by the state of Montana.

4. The applicant’s military records show that he enlisted in the Army Reserve delayed entry program for 8 years on 22 August 1996. He was discharged from that program upon his enlistment in the Regular Army on 10 July 1997. He reenlisted for 4 years on 31 October 2001. His 22 August 1996 DD Form 4/1, 4/2, and 4/3 (enlistment documents); and report of medical examination, show the spelling of his middle name as "Joesph," as does his DD Form 1966/1, Record of Military Processing. His 31 October 2001 4/1 and 4/2, DA Form 4789, and DA Form 3340-R of 31 October 2001 and 30 October 2001, respectively, show the same spellings of his middle name.

CONCLUSIONS:

1. The applicant's middle name is "Joseph" as shown on the certified copy of his birth certificate. The above mentioned documents reflecting his middle name as "Joesph," are erroneous. His middle name on those documents should be corrected.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the applicant's middle name is Joseph.
