         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests award of the Armed Forces Expeditionary Medal. He also requests that his deployment to the former Republic of Yugoslavia in support of Operation Joint Endeavor be shown on his DD Form 214 (Certificate of Release or Discharge form Active Duty).

3. The applicant states that he was deployed to the former Republic of Yugoslavia in support of Operation Joint Endeavor. He contends that his unit received the Armed Forces Expeditionary Medal and his DD Form 214 does not reflect this medal. In support of his application, he submits a copy of his DD Form 214; a questionnaire about military service, dated 9 March 2001; a Standard Form 180 (Request Pertaining to Military Records), dated 9 March 2001; letters, dated 23 May 2001, 30 November 2001 and 17 May 2002, from the U.S. Army Reserve Personnel Command in St. Louis, Missouri; an award certificate, dated 1 June 1996, for the Army Achievement Medal and a Certificate of Achievement, dated 12 June 1996.

4. The applicant’s military records show that he enlisted on 30 March 1995 for a period of 4 years. He successfully completed basic and advanced individual training in military occupational specialty 63B (light wheel vehicle mechanic). On 12 March 1999, the applicant was separated with a general discharge under the provisions of Army Regulation 635-200, chapter 14, for misconduct (commission of a serious offense).

5. The applicant's DD Form 214 does not show the Armed Forces Expeditionary Medal as an authorized award. His DD Form 214 does not show any deployments.

6. The applicant provided an award certificate, dated 1 June 1996, which shows that he received the Army Achievement Medal for meritorious achievement while assigned as a light wheel vehicle mechanic in support of Operation Joint Endeavor during the period 13 December 1995 through 21 March 1996. Permanent Orders 91-73 published this award on 15 April 1996.

7. The applicant also provided a Certificate of Achievement, dated 12 June 1996, for outstanding service in support of Operation Joint Endeavor.

8. The Board notes that the applicant's DD Form 214 does not show the Army Achievement Medal as an authorized award.

9. Army Personnel Command Message Number 99-100 (with a Date/Time Group of 121605Z March 1999) authorized award of both the Armed Forces Service Medal and the Armed Forces Expeditionary Medal, as a one-time exception to Department of Defense and Service policy, for qualifying service in support of Operations Joint Endeavor and Joint Guard in the Republic of Bosnia-Herzegovina. This exception allowed both service medals to be presented to personnel deployed in Bosnia-Herzegovina, aboard naval vessels operating in the Adriatic Sea and their respective air spaces during the period 1 June 1992 to 19 December 1996 (Operation Joint Endeavor) and during the period
20 December 1996 to 20 June 1998 (Operation Joint Guard). The exception also allowed only one award of each service medal for service in either or both Operation Joint Endeavor and Operation Joint Guard.

10. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. This regulation provides no authority to show deployments.

CONCLUSIONS:

1. The award certificate for the Army Achievement Medal and the Certificate of Achievement provided by the applicant confirm his service in support of Operation Joint Endeavor. Therefore, the applicant is entitled to award of the Armed Forces Expeditionary Medal and the Armed Forces Service Medal and correction of his DD Form 214 to show these awards.

2. The Board noted the applicant's request that his deployment in support of Operation Joint Endeavor be shown on his DD Form 214. However, in accordance with the governing regulation, deployments are not shown on the DD Form 214.

3. The applicant's DD Form 214 does not show the Army Achievement Medal as an authorized award. However, the applicant provided an award certificate that shows he was awarded the Army Achievement Medal that was published by Permanent Orders 91-73 on 15 April 1996. Therefore, the applicant is entitled to correction of his DD Form 214 to show award of the Army Achievement Medal.
4. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records, but only as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Armed Forces Expeditionary Medal, the Armed Forces Service Medal and the Army Achievement Medal.






2. That so much of the application as is in excess of the foregoing be denied.
