         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that his foreign service credit on his DD Form 214 (Report of Transfer or Discharge) be corrected.

3. The applicant states that he served 13 months in Vietnam.

4. The applicant’s military records show that after being inducted and entering active duty on 2 April 1962, he was assigned to Korea for 10 months and 25 days, from 24 May 1963 through 19 April 1964. When he reenlisted on 3 April 1964 he was issued a DD Form 214 that shows his foreign service in Korea as 10 months and 9 days.

5. The applicant served in Vietnam for 11 months and 5 days, from 16 September 1965 through 21 August 1966. On his separation from active duty he was issued a second DD Form 214 that shows his foreign service for Korea and Vietnam as 11 months and 23 days.

CONCLUSIONS:

1. The applicant's DD Form 214 issued on 2 April 1964 shows foreign service in Korea as 10 months and 9 days and should show 10 months and 25 days.

2. The applicant's DD Form 214 issued on 2 April 1970 shows foreign service in Korea and Vietnam as 11 months and 23 days and should show 1 year, 9 months, and 30 days.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case for the individual concerned be corrected:

         a. by correcting his DD Form 214, dated 2 April 1964, to show 10 months and 25 days foreign service; and

         b. by correcting his DD Form 214, dated 2 April 1970, to show 1 year, 9 months, and 30 days foreign service.







2. That so much of the application as is in excess of the foregoing be denied.
