         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to show award of the Purple Heart.

3. The applicant states that he was injured in Germany in November 1963. He states that he almost lost his life while riding in the back of a 5-ton truck which overturned, pinning him beneath the truck for 2 hours. He states that he still suffers physical ailments from the accident to this day. The attachments to his application he believes support his request. These records show the extent of the injuries he received as a result of the accident and the injuries suffered through the years and he presently still has. He feels he deserves this honor because he gave his all as so many other men and women have in the past and future. In support of his application, he submits letters, medical records from his military service, contemporary medical records, Veterans Administration medical records and claims for Post-Traumatic Stress Disorder (PTSD), and a copy of his DD Form 214 (Armed Forces Report of Transfer or Discharge).

4. The applicant’s military records show that he enlisted in the Regular Army on 13 June 1961 for a period of 3 years. He successfully completed basic combat training and advanced individual training (AIT). Upon graduation from AIT, he was awarded military occupational specialty (MOS) 710.00, Basic Army Administration. He subsequently was assigned to Germany with the 7th Cavalry Regiment with duties as a clerk.

5. On 27 November 1963, the applicant was riding in a trailer towed behind a 5-ton mess truck. The driver lost control of the vehicle causing it and the trailer to overturn. The applicant sustained numerous injuries, including a fracture of the right clavicle and scapula, and a collapsed right lung. He was hospitalized and recovered, returning to full duty.

6. On 18 March 1964, the applicant received a separation physical examination and was found qualified for separation. Item 38 of Standard Form 88 (Report of Medical Examination) indicates "No limitation of range of motion, or tenderness of spine, scapula, or ribs."

7. On 28 May 1964, the applicant was honorably released from active duty and transferred to the U.S. Army Reserve Control Group (Reinforcement). His DD Form 214 shows he completed 2 years, 11 months, and 16 days of active Federal service with no lost time. His only award was the Sharpshooter Marksmanship Badge (M-14 Rifle).

8. Army Regulation (AR) 600-8-22 (Military Awards) sets forth Department of the Army criteria, policy and instructions concerning individual military awards, the Good Conduct Medal, service medals and service ribbons, combat and special skill badges and tabs, unit decorations, and trophies and similar devices awarded in recognition of accomplishments. It provides, in pertinent part, that the Purple Heart (PH) is awarded for a wound sustained as a result of hostile action. Substantiating evidence must be provided to verify that: (1) the wound was the result of hostile action; (2) the wound required medical treatment; and (3) the medical treatment was made a matter of official record. The criteria for the PH has not changed throughout the years.

AR 600-8-22 also provides that the Good Conduct Medal (GCMDL) is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the Good Conduct Medal, disqualification must be justified.

10. AR 600-8-22 further provides, in pertinent part, for award of the National Defense Service Medal (NDSM) for honorable active service for any period between 27 June 1950 and 27 July 1954, 1 January 1961 and 14 August 1974, and 2 August 1990 and 30 November 1995. For the purpose of the award, the following persons are not considered as performing active service: (1) Guard and Reserve forces personnel on short tours of duty to fulfill training obligations under an inactive duty training program; (2) Any person on active duty for the sole purpose of undergoing a physical examination; (3) Any person on temporary active duty to serve on boards, courts, commissions and like organizations or on active duty for purposes other than extended active duty.

CONCLUSIONS:

1. The applicant served in the Regular Army in Germany during peacetime; he did not serve in a combat theater of operations. Furthermore, the applicant was injured in a vehicle accident; he was not wounded as a result of enemy actions. The regulation governing award of the Purple Heart clearly states that it is awarded for a wound (not an injury) sustained as a result of hostile action (not a vehicle accident in peacetime). The applicant is not entitled to the Purple Heart.

2. The applicant is entitled to award of the Good Conduct Medal and the National Defense Service Medal. These awards should be reflected on his DD Form 214.

3. In view of the foregoing, the applicant’s records should be corrected, but only as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by awarding to the individual concerned:

         (a) The Good Conduct Medal for the period from 13 June 1961 through 28 May 1964; and

         (b) The National Defense Service Medal for the period 13 June 1961 through 28 May 1964.

2. That so much of the application as is in excess of the foregoing be denied.
