PROCEEDINGS

         IN THE CASE OF:

         BOARD DATE: 17 April 2003
         DOCKET NUMBER: AR2002080020

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.

Mr. Carl W. S. Chun Director
Ms. Beverly A. Young Analyst

The following members, a quorum, were present:

Mr. Walter T. Morrison Chairperson
Mr. Harry B. Oberg Member
Mr. Ronald J. Weaver Member

The applicant and counsel if any, did not appear before the Board.

The Board considered the following evidence:

Exhibit A - Application for correction of military
records
Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.

2. The applicant requests correction of his DD Form 214 (Report of Separation from Active Duty) to show award of the Army Commendation Medal (ARCOM).

3. The applicant states that the ARCOM should be added to his DD Form 214. In support of his application, he submitted an award certificate and orders awarding him the ARCOM.

4. The applicant’s military records show that he served in the Army National Guard from May 1954 to July 1954. He enlisted in the Army on 8 February 1955, reenlisted twice and was honorably discharged on 17 April 1970. He enlisted in the Army again on 1 June 1971 and continued to serve on active duty until he was retired on 31 March 1976. His service personnel records contain four discharge documents. The applicant's retirement DD Form 214 does not show the ARCOM as an authorized award.

5. The applicant was awarded the ARCOM for meritorious service from 13 September 1974 through 31 March 1976 by 2nd Armored Division General Order Number 426, dated 24 March 1976.

CONCLUSIONS:

1. Orders show the applicant was awarded the ARCOM; therefore, his records will be amended to show this award.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned was awarded the ARCOM.

The record does not show that he was awarded any other ARCOM (with or without the “V” Device). The applicant’s DD Form 214 does not show that he was awarded the Purple Heart or the CIB. Furthermore, his Enlisted Qualification Record and the general orders awarding him the ARCOM with “V” Device show that he was an infantryman engaged in hostile action (at the time he was wounded) and as such met the prerequisites for award of the CIB.

The applicant states, in effect, that the computation of his active military service is in error and his separation document (DD Form 214) contains incorrect service dates in Item 18 (Record of Service), and should be corrected to show the accurate total of active military service and the total service for pay he completed as verified by his military records. The applicant requests that his military records be corrected to reflect award of the Purple Heart and POW (Prisoner of War) Medal. The evidence of record confirms that the applicant was wounded in action twice while serving in Korea. However, the record shows that he was awarded only one PH, for the 16 September 1950 wound. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by awarding him the Purple Heart 1st Oak Leaf Cluster, for being wounded in action on 2 November 1950, while serving in Korea; and by providing him a corrected separation document that...
