         The applicant and counsel, if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military records:

         Exhibit B - Military Personnel Records (including advisory opinion, if any).

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that she receive the remainder of the enlistment bonus in her revised enlistment contract.

3. The applicant states that an error at the enlistment center caused a discrepancy in the amount of enlistment bonus she received and is entitled to receive.

4. The applicant’s military records show that she entered active duty on 17 January 2001 in an advanced pay grade (E-3). She completed basic combat training and advanced individual training with award of the military occupational specialty (MOS) 96B (Intelligence Analyst)

5. The applicant’s enlistment packet includes a copy of a DA Form 3286-59 (USA Enlistment Program) which shows that she was guaranteed delayed entry, MOS, and enlistment program options of 9A (accelerated pay grade E-3 on entry) and 9C (cash enlistment Bonus based upon her college credits.)

6. Because a complete college transcript was not available she was originally shown to have only 54 credit hours. A second, complete, transcript was obtained prior to her entry onto active duty showing that she had completed 64 credit hours.

7. Military Personnel (Milper) message number 00-244 authorized enlistment bonus for college credits at the rate or $4,000.00 for 30-59 semester hours and $8,000.00 for individuals with 60 or more semester hours.

8. An advisory opinion was obtained from the US Total Army Personnel Command, Arlington, Virginia. The Chief, Accession Management Section, opined that in his review it appeared that the recruiting station had corrected the amount of entitlement, however it was done by overwriting the amount of the bonus. The Chief opined that the evidence showed that the applicant was entitled to the greater amount and recommended approval.


CONCLUSIONS
:

1. The Board finds that the applicant had the required number of college semester hours to receive the full $8,000.00 enlistment bonus.

2. The applicant’s records be corrected to show that she had the required credits for the full $8,000.00 enlistment bonus at the time of entry.

3. It is unjust not to pay the applicant the full amount of enlistment bonus to which she is entitled. Upon completion of all necessary administrative actions the proper documentation is to be forwarded to the pay center and the applicant is to receive those funds to which she is entitled.

4. In view of the foregoing findings and conclusions, correcting the applicant’s records as recommended below will correct an error.

RECOMMENDATION :

1. That all of the Department of the Army records related to this case be corrected by showing that the individual concerned had 64 semester credit hours and is entitled to the full $8,000.00 enlistment bonus.

2. Upon completion of the administrative corrections, the required documentation is to be forwarded to finance for payment of the remainder of her enlistment bonus.
