         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that his dates of service in the Asiatic-Pacific Theater during World War II be shown in item 30 (Remarks) on his retirement DD Form 214 (Report of Transfer or Discharge).

3. The applicant states that his service during World War II in the Asiatic-Pacific Theater was omitted on his retirement DD Form 214. In support of his application, he submits a copy of his WD AGO 53-98 (Military Record and report of Separation) and his retirement DD Form 214.

4. The applicant’s military records show that he entered active duty on 4 August 1942. He served as a cavalry unit commander (mechanized) in the Asiatic-Pacific Theater of Operations from 26 July 1945 through 5 June 1946 and was released from active duty on 12 September 1946. The applicant entered active duty again on 3 October 1950, served as a military police officer and retired in the rank of lieutenant colonel on 31 August 1972.

5. The applicant's WD AGO Form 53-98 shows he served in the Asiatic-Pacific Theater of Operations from 26 July 1945 through 5 June 1946.

6. Item 30 (Remarks) on the applicant's retirement DD Form 214 does not show his dates of service in the Asiatic-Pacific Theater of Operations during World War II.

7. Army Regulation 635-5 establishes the policies and procedures for completion and distribution of the DD Form 214. In pertinent part, it states that item
30 (Remarks) is used for entries authorized by Headquarters Department of the Army for which a separate block is not available and for completing entries that are too long for their blocks. There is no authorized block on the DD Form 214 to show duty assignments during World War II.

CONCLUSIONS:

1. The Board notes that the applicant's WD AGO Form 53-98 properly shows that he served in the Asiatic-Pacific Theater of Operations from 26 July 1945 through 5 June 1946.

2. Item 30 (Remarks) on the applicant's retirement DD Form 214 does not show his service in the Asiatic-Pacific Theater of Operations during World War II.

3. The Board considered the applicant's request to show his service in the Asiatic-Pacific Theater of Operations in item 30 (Remarks) on his retirement DD Form 214.



4. Based on the applicant's length of active service (27 years, 10 months and
20 days) and his total length of inactive and active service (36 years, 4 months and 23 days), the Board determined that, as an exception to policy, item
30 (Remarks) will be amended to show his service in the Asiatic-Pacific Theater of Operations from 26 July 1945 through 5 June 1946.

5. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by adding the entry, "Service in the Asiatic-Pacific Theater of Operations from
26 July 1945 through 5 June 1946" in item 30 (Remarks) on the DD Form 214 with an effective date of 31 August 1972 of the individual concerned.
