         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that Item 9 (Date of Birth) and
Item 10c (Date Inducted) of his separation document (DD Form 214) be corrected; and that the advanced individual training (AIT) and basic airborne courses he completed be added to Item 25 (Education and Training Completed) of his DD Form 214.

3. The applicant states, in effect, that his induction date was erroneously entered in Item 9 (Date of Birth) and his date of birth (DOB) was incorrectly entered in Item 10c (Date Inducted) of his 28 September 1970 separation document; and that the AIT and basic airborne courses he completed should have been included in Item 25 (Education and Training Completed) of this DD Form 214.

4. The applicant’s military records show that he was inducted into the Army of the United States on 19 March 1969. The DD Form 47 (Record of Induction) completed on him during his entrance processing listed his DOB as 8 March 1950, and the date of his induction into the Army as 19 March 1969. The DOB contained in the DD Form 47 and in the records created and maintained on him during his active duty tenure in the Army is the same, and was consistently used on all records and documents prepared on him throughout his Army service.

5. The applicant’s Enlisted Qualification Record (DA Form 20) confirms that he completed AIT and was awarded military occupational specialty (MOS) 11B (Light Weapons Infantryman). It also verifies that in September 1968, he completed the basic airborne course at Fort Benning, Georgia.

6. The DD Form 214 issued to the applicant on the date of his separation,
28 September 1970, confirms that he was discharged under the provisions of chapter 10, Army Regulation 635-200, in lieu of trial by court-martial. It also shows that at the time of his discharge, he had completed a total of only 1 year,
5 months, and 4 days of creditable active military service, and that he had accrued 36 days of lost time due to being absent without leave (AWOL).

7. Item 9 (Date of Birth) of the applicant’s DD Form 214 contained the entry
“8 Mar 69” and Item 10c (Date Inducted) contained the entry “19 Mar 50”. Item 25c (Education and Training) includes only one entry, which verifies that he completed MOS 11B (Light Infantryman) AIT, and does not include an entry showing his completion of the basic airborne course.


8. Army Regulation 635-5, in effect at the time, prescribed the separation documents which were prepared for individuals upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparing and distributing the DD Form 214.

9. Paragraph 2-42 contained guidance and instructions for authorized entries to be added to Item 25 (Education and Training Completed). It stated, in pertinent part, that all service schools, including major courses which were successfully completed, and military sponsored courses completed in civilian schools and colleges during the period covered by the DD Form 214 being prepared would be entered in Item 25. It further stipulated, that for enlisted personnel installation training courses (qualification courses), military correspondence courses, and
off-duty education courses completed successfully during the period covered by the DD Form 214 would be entered in Item 25.

CONCLUSIONS:

1. The Board notes the applicant’s contentions that his DOB and the date he was inducted were erroneously transposed in his 28 September 1970 separation document, and that Item 25 of this DD Form 214 does not include all the military education and training he successfully completed during his tenure on active duty, and it finds these claims have merit.

2. The evidence of record confirms that the applicant’s DOB is 8 March 1950, and that the date he was inducted into the Army was 19 March 1969. As a result of an obvious administrative error, these dates were erroneously entered in his DD Form 214, dated 28 September 1970. Therefore, the Board concludes it would be appropriate to correct these dates at this time.

3. The evidence of record also confirms that the applicant completed the basic airborne school at Fort Benning, Georgia, in September 1968. Therefore, it also finds that it would be appropriate to add this completed course to Item 25 (Education and Training Completed) of his DD Form 214 at this time.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by amending the following items of the 28 September 1970 DD Form 214 of the individual concerned to read as follows:

a. Item 9 (Date of Birth), by changing the date entered to read “8 March 1950” vice the current entry of 8 March 1969;

b. Item 10c (Induction Date), by changing the date entered to “19 March 1969” vice the current entry of 19 March 1950;

c. Item 25 (Education and Training), by adding the entry “Basic Airborne Course, Fort Benning, Georgia, 3 Weeks, September 1968”; and

d. By providing him a corrected separation document that reflects these changes.
