2. The applicant requests award of the Combat Infantryman Badge (CIB).
3. The applicant states that he was awarded the CIB while in Vietnam; however, there is no record of that award. He submits a copy of an order showing that he was awarded the Bronze Star Medal to support his contention.
4. The applicant’s military records show that he enlisted in the Army for three years on 29 July 1966, was trained as a clerk (Military Occupational Specialty [MOS] 70A10) at Fort Jackson, South Carolina, and completed airborne training at Fort Benning, Georgia. In March 1967 he was assigned as a clerk-typist to the 101st Administrative Company Support Battalion, 1st Brigade of the 101st Airborne Division in Vietnam. He was promoted to pay grade E-5 on 1 February 1968. He was awarded the Bronze Star Medal for meritorious service for the period 28 March 1967 to 18 March 1968.
5. The applicant returned to the United States and was assigned to Aberdeen Proving Ground in Maryland in May 1968. The applicant participated in three campaigns during his tour in Vietnam, and the 101st Administration Company was awarded the Republic of Vietnam Gallantry Cross Unit Citation with Palm and the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation for its actions during the applicant’s assignment to that unit.
6. The applicant’s DA Form 20 (Enlisted Qualification Record) shows that he was awarded an MOS of 71B (clerk-typist), and that his assignment in Vietnam was as a clerk-typist. There is no evidence that the applicant served as an infantryman, that he was awarded an infantry MOS (11B), or that he participated in combat.
7. The applicant was released from active duty on 28 July 1969 with an honorable characterization of service. He had three years of service. His DD Form 214 (Report of Transfer or Discharge) reflects that his specialty was 71B30, clerk-typist. He was awarded the National Defense Service Medal, the Parachutist Badge, the Vietnam Service Medal, the Vietnam Campaign Medal with 60 device, and the Expert Marksmanship Qualification Badge with rifle bar.
8. There are basically three requirements for award of the CIB. The soldier must be an infantryman satisfactorily performing infantry duties, must be assigned to an infantry unit during such time as the unit is engaged in active ground combat, and must actively participate in such ground combat. Campaign or battle credit alone is not sufficient for award of the CIB.
9. Army Regulation 600-8-22 provides that the Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the Good Conduct Medal, disqualification must be justified.
CONCLUSIONS:
1. There is no evidence and the applicant has not submitted any to show that he was an infantryman, that he was awarded an infantry MOS, or that he served in combat as an infantryman. He is not entitled to award of the CIB.
2. The applicant served his country faithfully and honorably. He is entitled to award of the Army Good Conduct Medal.
3. He participated in three campaigns during his tour in Vietnam. He is entitled to award of the Vietnam Service Medal with three bronze service stars (one for each campaign).
4. The applicant is entitled to award of the Republic of Vietnam Gallantry Cross Unit Citation with Palm and the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation.
5. He was awarded the Bronze Star Medal. That award should be reflected on his records.
6. In view of the foregoing, the applicant’s records should be corrected as recommended below.
RECOMMENDATION:
1. That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Army Good Conduct Medal, the Vietnam Service Medal with three bronze service stars, the Republic of Vietnam Gallantry Cross Unit Citation with Palm, the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, and the Bronze Star Medal.
2. That so much of the application as is in excess of the foregoing be denied.
