APPLICANT REQUESTS: That he be awarded the Purple Heart.
APPLICANT STATES: That he was wounded in the foot in Vietnam in the Delta in 1971 or 1972. He was with the 504th Infantry, 82d Airborne Division. He provides no supporting evidence.
EVIDENCE OF RECORD: The applicant's military records show:
He enlisted in the Regular Army on 7 December 1971 with no prior service. He departed absent without leave (AWOL) from 17 February through 7 April 1972. He was in confinement from 19 April through 15 June 1972. He departed AWOL from 17 through 27 July 1972. He was in confinement from 3 November 1972 through 25 January 1973. He departed AWOL from 20 February through 2 March 1973.
The applicant was discharged on 28 March 1973 for unsuitability after completing 8 months and 17 days of creditable active service with 215 days of lost time.
The applicant's DA Form 20 (Enlisted Qualification Record) shows he was assigned to no unit other than his basic combat training unit; the U. S. Army Personnel Control Facility, Fort Campbell, KY; and the U. S. Army Retraining Brigade, Fort Riley, KS.
There is no evidence of record to show the applicant served in Vietnam.
Army Regulation 600-8-22, Military Awards, provides for award of the Purple Heart for a wound sustained as a result of hostile action. Substantiating evidence must be provided to verify that the wound was the result of hostile action, the wound must have required treatment by a medical officer, and the medical treatment must have been made a matter of official record.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.
2. There is no evidence of record to show the applicant served in Vietnam or otherwise met the eligibility criteria for award of the Purple Heart.
3. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
