         The Board, established pursuant to authority contained in 10 U.S.C. 1552, convened at the call of the Chairperson on the above date. In accordance with Army Regulation 15-185, the application and the available military records pertinent to the corrective action requested were reviewed to determine whether to authorize a formal hearing, recommend that the records be corrected without a formal hearing, or to deny the application without a formal hearing if it is determined that insufficient relevant evidence has been presented to demonstrate the existence of probable material error or injustice.

         The applicant requests correction of military records as stated in the application to the Board and as restated herein.

APPLICANT REQUESTS: That her Home of Record (HOR) be changed to Ontario, CA.

APPLICANT STATES: The applicant makes no statement.

EVIDENCE OF RECORD: The applicant's military records show:

She entered the Delayed Entry Program on 28 April 1997. Her Enlistment/Reenlistment Document, DD Form 4, shows her HOR as Sharon, PA.
Her Questionnaire for National Security Positions, SF 86, completed at the time she entered the Delayed Entry Program, shows she lived in Sharon, PA from August 1993 to the present and in Williamsburg, PA from January 1980 to August 1993. She enlisted in the Regular Army from the Pittsburgh Military Entrance Processing Station on 16 May 1997.

The applicant reenlisted in the Regular Army on 29 September 2000. Her DD Form 4 shows her HOR as Sharon, PA.

In the processing of this case, an advisory opinion was obtained from the U. S. Army Enlisted Records and Evaluation Center (USAEREC). USAEREC noted that the Joint Federal Travel Regulation authorizes correction of a HOR only when, through a bona fide error, the place originally named at the time of current entry into the service was not in fact the actual home. In accordance with Army Regulation 601-280 (Total Army Retention Program), table 11-1, item 3, the HOR can be changed only if a break in service exceeds one full day.

A copy of the advisory opinion was provided to the applicant for comment or rebuttal. She did not respond within the given time frame.

DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:

1. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.

2. The evidence of record shows the applicant had lived in Pennsylvania for 14 years prior to her initial enlistment and in Sharon, PA for 4 years prior to her initial enlistment. It appears that Sharon, PA was properly listed as her HOR. Unless she has a break in service of more than 1 day, her HOR will remain Sharon, PA.

3. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
