         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that the separation date on her 1999 separation document be corrected to reflect that she was separated on 16 November 1999 vice 16 October 1999. In support of her request she submits copies of orders transferring her to the Transition Point for separation processing, copies of her final payment voucher, and copies of a transportation ticket.

3. Records available to the Board indicate the applicant entered active duty on
1 September 1999. Although documents associated with her administrative separation were not available to the Board, the applicant was apparently determined to have medical conditions which, had they been identified prior to her entry on active duty, would have precluded her enlistment.

4. Orders issued by the United States Army Training Center and Fort Jackson on 12 November 1999 reassigned the applicant to the Transition Point at Fort Jackson for the purpose of separation processing. Her separation date was identified as 16 November 1999. A pre-separation counseling checklist was completed by the applicant, and authenticated by a transition counselor at Fort Jackson on 16 November 1999. The applicant's final payment voucher indicates her separation date as 16 November 1999 and a travel ticket receipt, issued by Carlson Wagonlit (a government travel agency) on 16 November 1999, authorized the applicant's military transportation following separation.

5. The applicant's 1999 separation document, however, indicates a separation date of 16 October 1999 and a "net active service" period of 1 month and 16 days.

CONCLUSIONS:

1. The Board is convinced, based on available evidence that an error occurred in the completion of the applicant's 1999 separation document. Her transition orders, separation counseling checklist, final payment voucher and transportation receipt, all support a conclusion that the applicant was discharged on
16 November 1999 and not 16 October 1999. The Board concludes it would be appropriate and in the interest of justice to correct her separation document accordingly.

2. The Board also notes that as a result of the correction, the applicant's "net active service" entry will also require recalculation.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.




RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the applicant was discharged on 16 November 1999, vice
16 October 1999, and that her net active service entry be recalculated accordingly.
