         I certify that hereinafter is recorded the record of consideration of the Army Board for Correction of Military Records in the case of the above-named individual.

         The Board, established pursuant to authority contained in 10 U.S.C. 1552, convened at the call of the Chairperson on the above date. In accordance with Army Regulation 15-185, the application and the available military records pertinent to the corrective action requested were reviewed to determine whether to authorize a formal hearing, recommend that the records be corrected without a formal hearing, or to deny the application without a formal hearing if it is determined that insufficient relevant evidence has been presented to demonstrate the existence of probable material error or injustice.

         The applicant requests correction of military records as stated in the application to the Board and as restated herein.

         The Board considered the following evidence:

APPLICANT REQUESTS: That his Report of Transfer or Discharge, DD Form 214, be amended to show he was on active duty, not active duty for training.

APPLICANT STATES: That he was commissioned in June 1955. Due to an oversupply of second lieutenants, he was given the choice of reporting in two years. After two years, there was still an oversupply and he was given the choice of 2 years of active duty and 6 years of inactive Reserve or 6 months active duty and 7 1/2 years Active Reserve. He chose the latter and reported on 15 June 1957 to Fort Belvoir, VA for 13 weeks of the officer basic course and then to active duty at Fort Sill, OK. He provides his DD Form 214 as supporting evidence.

EVIDENCE OF RECORD: The applicant's military records show:

He was appointed a second lieutenant in the U. S. Army Reserve on 4 June 1955.

Letter Orders 6-27, Headquarters, Fourth Army dated 3 June 1955 ordered him to active duty to attend the Engineer Officer Basic Course effective 1 June 1957. Letter Orders 5-277, Headquarters, Fourth Army dated 22 May 1956 rescinded Letter Orders 6-27 and ordered him to active duty for training effective 15 June 1957 for six months unless extended with the applicant's consent. Special Orders 164, Department of the Army dated 21 August 1957 released him from attached to the U. S. Army Engineer School and attached him to the 855th Engineer Battalion, Fort Sill, OK effective 1 October 1957. His DD Form 214 shows he was released to the U. S. Army Reserve on 14 December 1957 after completing 6 months of active duty for training.

DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:

1. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.

2. The evidence of record shows that, while the applicant was originally ordered to active duty, those orders were rescinded and he was ordered to active duty for training for 6 months. It appears his further attachment to Fort Sill, OK was to round out his active duty for training commitment to a full 6 months.

3. In view of the foregoing, there is no basis for granting the applicant's request.

DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
