         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests in two different DD Forms 149 (Application for Correction of Military Records) that his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be corrected to show the Meritorious Unit Commendation award and "any correction to [his] DD Form
214 to support [his] claim for disability."

3. In regard to the award of the Meritorious Unit Commendation, the applicant states that he served in Vietnam and was assigned to a unit that was awarded the Meritorious Unit Commendation. He stated that this award does not appear on his DD Form 214. In support of his application the applicant submits a copy of the 369th Signal Battalion web page.

4. In regard to the applicant's request for "any correction to [his] DD Form 214 to support his disability claim," he provided no information regarding his claim for disability or the specific request for correction of his records. This matter was addressed by separate correspondence and will not be addressed further in these proceedings.

5. The applicant’s military records show that he enlisted in the Regular Army on
23 October 1967 for 3 years. On or about 29 December 1968, the applicant arrived in Vietnam. He was assigned to Company C, 369th Signal Battalion as a senior microwave radio repairman. On or about 28 December 1969, the applicant departed Vietnam for assignment in the United States. On 22 October 1970, the applicant was honorably released from active duty.

6. His DD Form 214 shows the awards of the National Defense Service Medal, the Vietnam Service Medal with 4 bronze service stars, the Vietnam Campaign Medal with device 1960, the Good Conduct Medal, 2 Overseas Service Bars, the Sharpshooter Badge (M-16), and the Sharpshooter Badge (M-14). It does not show the Meritorious Unit Commendation.

7. General Orders 3078, dated 1 December 1969, from Headquarters, 1st Signal Brigade filed in the applicant's official military personnel record awarded him the Army Commendation Medal for the period 24 April 1969 to 1 December 1969. This award is not shown on his DD Form 214.

8. Department of the Army Pamphlet 673-3 (Unit Citation and Campaign Participation Credit Register) lists the unit awards received by units serving in Vietnam. This document shows the unit to which the applicant was assigned was cited for award of the Meritorious Unit Commendation for the period 1 April 1968 through 31 March 1970, by Department of the Army General Order 2, dated 1971.

9. Department of the Army General Orders 8, dated 1974, announced award of the Republic of Vietnam Gallantry Cross with Palm Unit Citation to Headquarters, U. S. Military Assistance Command and its subordinate units during the period
8 February 1962 to 28 March 1973 and to Headquarters, U. S. Army Vietnam and its subordinate units during the period 20 July 1965 to 28 March 1973.

CONCLUSIONS:

1. The Board considered the applicant's request for correction of his records to show the Meritorious Unit Commendation.

2. While the applicant was assigned to the 369th Signal Battalion, it was cited for award of the Meritorious Unit Commendation and the Republic of Vietnam Gallantry Cross with Palm Unit Citation. Therefore, he is entitled to correction of his DD Form 214 to show these unit awards.

3. General Orders show the applicant was awarded the Army Commendation Medal. Therefore, he is entitled to correction of his record to show this award.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by amending the applicant's DD Form 214 to show the Meritorious Unit Commendation, the Republic of Vietnam Gallantry Cross with Palm Unit Citation, and the Army Commendation Medal.
