         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that item 36 of his WD AGO Form 53-55 (Enlisted Record and Report of Separation) be corrected to show that he departed the European Theater of Operations on 7 November 1946, vice the 7 November 1945 date shown. He states that he wants his record corrected.

3. The applicant’s WD AGO Form 53-55 shows that he was inducted into the Army on 30 April 1945, departed for the European Theater of Operations on 11 October 1945, arriving on the 21st of that month, and departed for the United States on 7 November 1945. He was discharged on 20 December 1946. His WD AGO Form 53-55 shows that he had 1 year, 1 month, and 8 days of foreign service. His final payment worksheet shows that he arrived in the United States on 18 November 1946, and that he received foreign service pay for the period 1 November 1946 through 18 November 1946.

CONCLUSIONS:

1. Item 36 of the applicant’s WD AGO Form 53-55 is obviously incorrect. The applicant had over one year of foreign service. He did not depart for the United States on 7 November 1945, 17 days after his arrival. He left in 1946, not 1945.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the applicant departed the European Theater of Operations for the United States on 7 November 1946, vice the 7 November 1945 date shown.
