         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of the military occupational specialty (MOS) shown on his separation document.

3. The applicant states that his WD AGO 53-55 (Enlisted Record and Report of Separation Honorable Discharge) incorrectly reflects that during World War (WW) II he served as an ammunition handler. He says that he was a machine gunner.

4. In support of his request the applicant provided a copy of his WD AGO 53-55.

5. The applicant’s military records were lost or destroyed in the 1973 fire at the National Personnel Records Center. Information herein is based upon the documents provided by the applicant.

6. His WD AGO Form 53-55 shows that he was inducted on 21 July 1946, his MOS and number are shown as 605, ammunition bearer. He was assigned to Company M, 329th Infantry Regiment, 83rd Infantry Division in the European Theater of Operations from 15 January 1945 to approximately 22 June 1946. He was honorably separated on 29 June 1946, in the rank of private first class.

7. His WD AGO 53-55 also show he was awarded the Combat Infantryman Badge, the Rifle Marksman Badge, the European-African-Middle Eastern Theater Ribbon with three Bronze Service Stars, the Good Conduct Medal and the Victory Medal WWII.

8. The WWII & Korea MOS list indicates that the title for MOS 605 was heavy machine gunner.

9. Army Regulation 600-8-22 provides in pertinent part, that the Bronze Star Medal is awarded for heroism and for meritorious achievement or service in military operations against an armed enemy. The Bronze Star Medal is authorized for each individual who was cited in orders or awarded a certificate for exemplary conduct in ground combat between 7 December 1941 and 2 September 1945 or whose achievement or service, during that period, was confirmed by documents executed prior to 1 July 1947. An award of the Combat Infantryman Badge or the Combat Medical Badge is considered to be a citation in orders. This means, in effect, that the Bronze Star Medal is to be awarded to individuals who were authorized either badge for service during WWII.

10. Department of the Army Pamphlet 672-1 (Unit Citation and Campaign Participation Credit Register) shows the unit to which the applicant was assigned, the 329th Infantry Regiment, 83rd Infantry Division was awarded occupation credit for Germany for the period 2 May through 31 October 1945.


CONCLUSIONS
:

1. The proper title for MOS 605 is Heavy Machine Gunner and it would be proper to correct the applicant's WD AGO 53-55 to reflect the same.

2. By virtue of his having been awarded the Combat Infantryman Badge during WWII service, he is entitled to award of the Bronze Star Medal under rules established subsequent to WWII for awarding the Bronze Star Medal.

3. Additionally, he served during the authorization period for award of the Army of Occupation Medal with Germany clasp and is entitled to correction of his discharge document to show this award.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by:

         a. showing on the WD AGO 53-55 of the individual concerned that his MOS was heavy machine gunner;

b. showing that based on his award of the Combat Infantryman Badge he is entitled to the Bronze Star Medal; and

c. showing that he was awarded the Army of Occupation Medal with Germany clasp.
