         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his military records to show that he was assigned to the 155th Station Hospital, Unit C.

3. The applicant states that his DD Form 214 (Report of Separation From The Armed Forces of the United States) does not reflect that he was assigned to the 155th Station Hospital, Unit C.

4. In support of his request, he submits a copy of his DD Form 214 and Special Orders Number 84, issued by the 161st Station Hospital on 6 July 1950 that reflects that he was attached to the 155th Station Hospital, Unit C.

5. The applicant’s military records were lost or destroyed in the 1973 fire at the National Personnel Records Center. Information herein is based upon the documents provided by the applicant.

6. His DD Form 214 shows that he entered the Regular Army on 14 August 1948 and completed Medical Field Service School training. Item 28 (Most Significant Duty Assignment) of the separation document, contains the entry Company K, 19th Infantry Regiment. He was honorably discharged on 2 May 1952, in the grade of corporal.

7. Department of the Army Special Regulation 615-369-1 (Enlisted Personnel), provides, in pertinent part, that preparers of the DD Form 214 will enter in item 28 the last unit, or similar element, the individual was a part of while moving to a separation activity. Assignments to units for the purpose of transfer from an overseas command to the United States are considered part of the movement to a separation activity. Assignment to a medical holding detachment for the purpose of separation by reason of disability will not be considered a duty assignment. The title and/or number of the organization will be entered precisely as indicated in the service record.

8. The same regulation allows that additional clarifying items will be entered under item 38 (Remarks) of the DD Form 214.

9. The Board notes that the applicant served in Korea during the Korean Conflict, which would entitle him to the Korean War Service Medal. As a matter of information, on the occasion of the 50th anniversary of the Korean War, the Government of the Republic of Korea issued the Korea War Service Medal to pay tribute to eligible Korean War veterans for their historic endeavors to preserve the freedom of the Republic of Korea and the free world. On 20 August 1999, the Department of Defense approved acceptance and wear of this foreign service award to eligible US veterans of the Korean War, or their surviving next of kin. The medal is provided at no cost to veterans.


CONCLUSIONS:

1. The applicant does not contend that the unit listed on his DD Form 214 as the "Most Significant Duty Assignment" is in error, but rather he is asking that his assignment to the 155th Station Hospital, Unit C also be reflected. The governing regulation for the completion of the DD Form 214 then in effect allows for clarifying items to be added to the "Remarks" section. The Board concludes that it would be appropriate to add the applicant's assignment to the 155th Station Hospital, Unit C in the "Remarks" section of his DD Form 214.

2. The Department of Defense assigned responsibility to the Department of the Air Force for distribution of the Korean War Service Medal to eligible veterans or their surviving next of kin. To apply, veterans must submit a copy of their discharge paper (DD Form 214) to the Awards and Decorations Section, Headquarters, Air Force Personnel Center, 550 C Street West Suite 12, Randolph Air Force Base, Texas 78150-4714. A sample request form is being provided to the applicant. Once the Department of the Air Force has authorized the Korean War Service Medal, the applicant may apply to the Army Board for Correction of Military Records to add this foreign award to his or her DD Form 214.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing in the Remarks section of DD Form 214 that the individual concerned was assigned to the 155th Station Hospital, Unit C.
