         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that his records be corrected to reflect unit awards associated with his service in Vietnam. The applicant states that he is entitled to a Republic of Vietnam Gallantry Cross Unit Citation with Palm, a Valorous Unit Award, a Meritorious Unit Commendation, and the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation. In support of his request he submits a copy of an extract from Department of the Army Pamphlet 672-3, a copy of his separation document, and a copy of his Department of the Army Form 20 (Enlisted Qualification Record).

3. Although the applicant's military personnel file was not available to the Board, information contained in the documents submitted by the applicant indicate he entered active duty on 13 July 1967 and served in Vietnam between December 1967 and December 1968. While in Vietnam, the applicant was assigned to Battery D, 8th Battalion, 6th Artillery. It is unclear why the applicant highlighted the 6th Artillery Detachment information in Department of the Army Pamphlet 672-3 when he was actually assigned to the 8th Battalion of the 6th Artillery.

4. A review of Department of the Army Pamphlet 672-3 confirms that the applicant's unit (3rd Battalion, 6th Artillery) was awarded a Meritorious Unit Commendation, a Republic of Vietnam Gallantry Cross Unit Citation with Palm, and the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, while he was a member of that organization. Those awards were omitted from his separation document. There is, however, no indication that the unit was awarded a Valorous Unit Award during the applicant's tenure with the unit.

CONCLUSIONS:

1. The evidence confirms the applicant was a member of the 8th Battalion, 6th Artillery when the unit was awarded a Meritorious Unit Commendation, a Republic of Vietnam Gallantry Cross Unit Citation with Palm, and the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation. His records should be corrected accordingly.

2. There is, however, no indication the unit was awarded a Valorous Unit Award while the applicant was assigned. As such there is no basis to correct his records to reflect entitlement to that decoration.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by showing that the individual concerned is entitled to a Meritorious Unit Commendation, a Republic of Vietnam Gallantry Cross Unit Citation with Palm, and the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation.

2. That so much of the application as is in excess of the foregoing be denied.
