         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his Vietnam Gallantry Cross with Silver Star and his Bronze Star Medal (BSM) be added to his DD Form 214, Armed Forces of the United States Report of Transfer or Discharge.

3. The applicant submits copies of documents which show that he was awarded the Vietnam Gallantry Cross with Silver Star and BSM. These documents include General Orders Number 199, 1st Aviation Brigade, dated 24 August 1966, which awarded the applicant the BSM; and a letter from Headquarters, US Army Vietnam (USARV), dated 22 November 1966, which states that the Vietnam Gallantry Cross with Silver Star, awarded to the applicant by the Republic of Vietnam for his heroic actions during the period 4 and 5 April 1966, had been accepted and approved by the Commanding General, USARV.

4. The applicant’s military records show that he was commissioned in the Regular Army on 15 June 1956 with 2 years, 7 months and 26 days of prior active enlisted service. He was awarded the area of concentration of fixed wing aviator and was promoted to major.

5. The applicant served in Vietnam from 24 August 1965 to 16 August 1966. While in Vietnam, he was assigned to the 56th Transportation Company from 26 August to 4 October 1965, and the 73rd Aviation Company from 5 October 1965 to 12 August 1966.

6. The applicant was honorably released from active duty on 30 November 1966 by reason of unqualified resignation. His separation document shows that he was awarded the Senior Army Aviator Badge, the Purple Heart, the National Defense Service Medal with oak leaf cluster, Vietnam Service Medal, the Vietnam Campaign Medal, and the Air Medal with six oak leaf clusters.

7. Department of the Army Pamphlet 672-3, Unit Citation and Campaign Participation Credit Register, shows that the applicant served in Vietnam during the Vietnam Defense Campaign (8 March to 24 December 1965), the Vietnam Counteroffensive (25 December 1965 to 30 June 1966), and the Vietnam Counteroffensive Phase II (I July 1966 to 31 May 1967).

CONCLUSIONS:

1. The applicant was, in fact, awarded the BSM and the Vietnam Gallantry Cross with Silver Star, and has the proper documents to substantiate that those decorations should have been entered on his DD Form 214.

2. In addition, the applicant should also have been awarded three bronze service stars to his Vietnam Service Medal, and two MUC's.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION
:

That all of the Department of the Army records related to this case be corrected by:

         a. showing that the individual concerned was awarded three bronze service stars to his Vietnam Service Medal;

         b. showing he was awarded two MUC's; and

         c. by adding these decorations to his DD Form 214 along with his BSM and the Vietnam Gallantry Cross with Silver Star.
