         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that the effective date of his release from active duty be corrected.

3. The applicant states that item 11d of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) is incorrect and should be 10 August 1962.

4. Except for the applicant’s DD Form 214, his military records are not available. That form shows that he entered on active duty on 15 October 1961, served on active duty for 9 months and 26 days, and was released from active duty, also on 15 October 1961, an obvious error.

CONCLUSIONS:

1. Item 11d of the applicant’s DD Form 214 should be corrected to show that he was released from active duty on 11 August 1962, 9 months and 26 days from the date that he entered on active duty. The applicant’s calculation to 10 August 1962 is one day off.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was released from active duty on 11 August 1962.
