         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that her discharge be changed to show that she was a 1st lieutenant.

3. The applicant states, in effect, that she was promoted to 1st lieutenant on 13 December 1945, and placed on terminal leave on 26 January 1946, so her promotion was not reflected on her discharge. In support of her request, she submits a copy of her WD AGO Form 53-98, Military Record and Report of Separation-Certificate of Service and a copy of a special order dated 13 December 1945 promoting her to the grade of 1st lieutenant.

4. The applicant’s military records were lost or destroyed in the 1973 fire at the National Personnel Records Center. Information herein was derived from documents provided by the applicant.

5. The applicant’s WD AGO Form 53-98 shows that she entered active duty on 20 September 1944, and served in the European Theater of Operations as a general duty nurse from 30 November 1944 to 18 January 1946. The Certificate of Service also shows that she was placed on terminal leave from 26 January 1946 to 28 February 1946.

6. Her awards include the European-African-Middle Eastern Campaign Medal with 2 bronze service stars, the World War II Victory Medal and the World War II Honorable Service Lapel Button.

7. Special Orders 132, issued by Headquarters Theater Service Forces, European Theater on 13 December 1945, show that the applicant was temporarily promoted from 2nd lieutenant to 1st lieutenant, Army Nurse Corps, with rank from the date of the order. On 20 June 1947, a Presidential appointment was issued confirming the applicant’s appointment to the grade of 1st lieutenant.

CONCLUSIONS:

1. The evidence of record shows that the applicant was appointed to the grade of 1st lieutenant in the Army Nurse Corps effective 13 December 1945. She departed the European Theater on 26 December 1945, arriving in the States on 18 January 1946, and was placed on terminal leave on 26 January 1946.

2. Considering the abbreviated time frame of her movement from Europe to the separation point and the likely turmoil then associated with demobilization processing, it is probable that her promotion orders never caught up with her records and she was separated in the grade of 2nd lieutenant instead of 1st lieutenant. It would be appropriate therefore to correct her record and reflect her grade as 1st lieutenant on her Certificate of Service.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was promoted to the grade of 1st lieutenant on 13 December 1945.
