         DOCKET NUMBER: AR2002071822

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.

Mr. Carl W. S. Chun Director
M . Analyst

The following members, a quorum, were present:

Mr. Raymond V. O'Connor, Jr. Chairperson
Ms. Margaret K. Patterson Member
Mr. Arthur A. Omartian Member

The applicant and counsel if any, did not appear before the Board.

The Board considered the following evidence:

Exhibit A - Application for correction of military
records
Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.

2. The applicant requests that his discharge document be corrected to show that he was assigned to the 331st Field Artillery Battalion, 86th Infantry Division.

3. The applicant states that he was assigned to the 331st Field Artillery Battalion, 86th Infantry Division, not Battery B, 538th Field Artillery Battalion, during the majority of his time in World War (WW) II and he would like to have the
331st Field Artillery Battalion, 86th Infantry Division, reflected on his discharge.

4. In support of his request, he submits a copy of his WD AGO Form 53-55 (Enlisted Record and Report of Separation - Honorable Discharge), WD AGO Form 100 (Separation Qualification Record), and pictures, he asserts, show him as a member of the 86th Infantry Division.

5. The applicant’s military records were lost or destroyed in the 1973 fire at the National Personnel Records Center. Information herein is based upon the documents provided by the applicant.

6. His WD AGO Form 53-55 shows that he was inducted on 5 February 1946, was awarded the military occupational specialty (MOS) of Airplane & Engine Mechanic, 747, and served outside the continental U.S. from 17 June 1946 to 16 February 1947. He was honorably separated on 10 April 1947, as a Technician 5th Grade.

7. The WD AGO Form 100 reflects that he was assigned to the 331st Field Artillery Battalion, 86th Infantry Division, during WWII.

8. His WD AGO Form 53-55 shows he was awarded the WWII Victory Medal and the Sharpshooter Marksmanship Qualification Badge with Rifle Bar.

9. Army Regulation 600-8-22, Military Awards, provides for award of the WWII Honorable Service Lapel Button. It is awarded for service between 8 September 1939 and 31 December 1946.

CONCLUSIONS:

1. The evidence of record shows that the applicant was assigned to the 331st Field Artillery Battalion, 86th Infantry Division, during WWII and is entitled to have this unit shown on his separation document.

2. Additionally, he served during the authorization period for award of the WWII Honorable Service Lapel Button and is entitled to correction of his discharge document to show the award.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by:

         a. showing that the organization of the individual concerned during WWII was the 331st Field Artillery Battalion, 86th Infantry Division; and

         b. showing he was awarded the WWII Honorable Service Lapel Button.
