         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, the correction of his records to reflect that he was awarded four bronze service stars to be worn on his Vietnam Service Medal, the Meritorious Unit Commendation, the Republic of Vietnam Gallantry Cross with Palm Unit Citation, and the Republic of Vietnam Civil Actions Honor Medal-First Class Unit Citation.

3. The applicant states, in effect, that at time of his discharge the awards had not been awarded.

4. The applicant’s military records show that he entered the Regular Army on 27 December 1968 and was trained as a communications center specialist. He served in Vietnam for the period 11 August 1969 through 10 August 1970, while assigned to Headquarters and Headquarters Company, 303rd Radio Research Battalion, and attached to the 405th Radio Research Detachment. He was honorably transferred to the US Army Reserve on 23 March 1972, in the rank of specialist.

5. His DD Form 214, separation document, reflects that he was awarded the National Defense Service Medal, the Vietnam Service Medal, the Vietnam Campaign Medal, the Army Commendation Medal, the Good Conduct Medal, 2 Oversea Service Bars, and the M-16 Expert.

6. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that a bronze service star is based on qualifying service, for each campaign listed in Appendix B of this regulation and states that authorized bronze service stars will be worn on the appropriate service medal. In the applicant’s case, he is entitled to four bronze service stars for participating in the Vietnam Summer-Fall 1969; the Vietnam Winter-Spring 1970; the DA Sanctuary Counteroffensive and the Vietnam Counteroffensive, Phase VII, Campaigns.

7. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the unit awards received by units serving in Vietnam. This document shows that the unit to which the applicant was assigned was cited for award of the Meritorious Unit Commendation for the period 1 August 1968 through 30 September 1969 by Department of the Army General Order Number 51, dated 1971; the Republic of Vietnam Gallantry Cross with Palm Unit Citation for the period 1 January 1970 through 3 March 1971 by Department of the Army General Order Number 6, dated 1974, and the Republic of Vietnam Civil Actions Honor Medal-First Class Unit Citation, for the period 1 January 1969 through 30 April 1971, by Department of the Army General Order Number 6, dated 1974.



CONCLUSIONS:

1. The record shows that the applicant is entitled to four bronze service stars to be worn on his Vietnam Service Medal, the Meritorious Unit Commendation, the Republic of Vietnam Gallantry Cross with Palm Unit Citation, and the Republic of Vietnam Civil Actions Honor Medal-First Class Unit Citation. He is therefore entitled to have these awards shown on his DD Form 214.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded four bronze service stars to be worn on his Vietnam Service Medal, the Meritorious Unit Commendation, the Republic of Vietnam Gallantry Cross with Palm Unit Citation, and the Republic of Vietnam Civil Actions Honor Medal-First Class Unit Citation.
