         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that a second award of the Army Superior Unit Award (ASUA) and a Meritorious Unit Commendation (MUC) be added to his record.

3. The applicant states, in effect, that he is entitled to a second ASUA and to a MUC based on his service in the 13th Signal Battalion, Fort Hood, Texas. He claims these awards were authorized for periods that he was assigned and serving in the unit; however, the orders authorizing them were not published until after he was discharged. Therefore, these awards were not included in the
DD Form 214 issued to him upon his separation from active duty.

4. The applicant’s military records show that on 2 March 1989, he entered active duty in the Regular Army, and that he continuously served for 3 years, 4 months, and 27 days until 28 July 1992, at which time he was honorably separated, by reason of physical disability with severance pay.

5. The applicant’s Personnel Qualification Record (DA Form 2-1) confirms, in Item 35 (Record of Assignments), that he was assigned to and served in the
13th Signal Battalion, Fort Hood, Texas, from 28 August 1989 through 28 July 1992, the date of his discharge.

6. The DD Form 214 issued to the applicant on the date of his separation confirms that the applicant earned the following awards during his active duty tenure: Army Commendation Medal; National Defense Service Medal; Army Service Ribbon; Marksman Marksmanship Badge (Rifle); Army Superior Unit Award; Army Lapel Button; Southwest Asia Service Medal with 3 bronze service stars; and the Kuwait Liberation Medal. In addition, as a result of action by this Board, a correction to his separation document (DD Form 215), dated
13 September 2001, was issued that added the Army Good Conduct Medal to the list of authorized awards listed in his separation document.

7. The Army Unit Award Citations Listing maintained by the Awards Branch, Total Army Personnel Command (PERSCOM), Alexandria, Virginia, confirms that during the applicant’s assignment tenure, the 13th Signal Battalion earned the following unit awards for the periods indicated as authorized in the Department of the Army General Orders (DAGO) Number (#) listed: ASUA, 1 October 1987-
30 September 1989, DAGO # 15, dated 10 October 1990; ASUA, 1 October 1989-30 September 1990, DAGO # 6, dated 31 January 1992; and MUC,
23 September 1990-15 March 1991, DAGO # 27, dated 27 December 1994.


CONCLUSIONS:

1. The Board notes the applicant’s request that two unit awards to which he is entitled and that were authorized subsequent to his discharge be added to his record, and it finds this claim has merit.

2. The evidence of record confirms that during the applicant’s assignment tenure with the 13th Signal Battalion, this unit was awarded two ASUAs and the MUC. However, only one of these awards was included in the list of authorized awards contained in the applicant’s separation document. Therefore, the Board concludes it would be appropriate to add the omitted awards to his separation document at this time.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned earned the second award of the Army Superior Unit Award and a Meritorious Unit Commendation; and by issuing him a corrected separation document that includes these awards.
