         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 be corrected to show that he received four awards of the Army Achievement Medal, two awards of the Army Commendation Medal, an Overseas Service Ribbon, an Army Good Conduct Medal, an award for his participation in Task Force 99-02 in Kuwait, and an Expert Qualification Badge.

3. The applicant states that his personnel records should be reviewed to substantiate that he received those awards. He states that he attached citations supporting his request. There are no citations attached to his application.

4. The applicant’s military records show that he enlisted in the Army for three years on 31 August 1995. He reenlisted for three years on 19 May 1998 while stationed in Camp Hovey in Korea. The applicant’s reconstructed DA Form 2-1 (Personnel Qualification Record) contained on his microfiche, shows that he served in Korea from 28 May 1998 to 4 June 1998 for a period of 12 months (an obvious error), and that he completed an overseas tour of duty. That form shows award of the Overseas Service Ribbon.

5. The applicant was released from active duty on 18 May 2001 in the pay grade of E-4. He had 5 years, 8 months, and 18 days of service.

6. Army Regulation 600-8-22 provides, in pertinent part, that the Army Commendation Medal is awarded for heroism and for meritorious achievement or service. The Army Achievement Medal is awarded for meritorious service or achievement of a lesser degree than required for award of the Army Commendation Medal. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required.

7. Army Regulation 600-8-22 provides that the Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the Good Conduct Medal, disqualification must be justified.

8. That regulation provides for award of marksman qualification badges to indicate degrees in which an individual has qualified in a prescribed record course. Basic qualification badges are of three classes – Expert, Sharpshooter, and Marksman.

CONCLUSIONS:

1. The applicant is entitled to award of the Overseas Service Ribbon. That award should be reflected on his DD Form 214.
2. There is no evidence to show that the applicant was awarded, or recommended for award of the Army Commendation Medal, the Army Achievement Medal, the Army Good Conduct Medal, or an Expert Qualification Badge. His records do not reflect service on a task force in Kuwait. Consequently, there is insufficient evidence to grant his request regarding these awards.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Overseas Service Ribbon.

2. That so much of the application as is in excess of the foregoing be denied.
