2. The applicant requests that his record be corrected to show that his date of birth on his DD Form 214 is 25 January 1972 vice the 29 September 1995 date shown; that he receive a second award of the Army Commendation Medal; and that he be awarded a campaign badge.
3. The applicant states that an award of the Army Commendation Medal was approved on 2 July 1998, and that he served in Bosnia from 20 December 1995 to 21 June 1996. He provides a copy of his DD Form 214, a copy of an approved award of the Army Commendation Medal for the period 14 May 1994 to 28 July 1998, and a copy of a certification of vital record from Waco, Texas showing his date of birth as 25 January 1972.
4. The applicant’s military records show that he enlisted in the Army for five years on 29 July 1993. His DD Form 4 shows his date of birth as 25 January 1972. A certificate of birth from the Medical Center in Odessa, Texas, shows his date of birth as 25 January 1972. The applicant completed training, and in May 1994 was assigned to a military intelligence battalion in Germany.
5. The applicant was awarded the Army Commendation Medal on 5 June 1997 for the period 11 December 1995 to 21 June 1996. He was also awarded that medal on 8 July 1998 for the period 14 May 1994 to 28 July 1998.
6. The applicant was discharged on 28 July 1998. His DD Form 214 shows his date of birth as 29 September 1995, the same date as his date of rank. It shows that he was awarded the Army Commendation Medal, the Good Conduct Medal, the National Defense Service Medal, the Army Service Ribbon, the Overseas Service Ribbon, the Driver and Mechanic Badge (Driver-W Bar), the Armed Forces Service Medal, and the NATO Medal. He served in Bosnia from 20 December 1995 to 21 June 1996.
7. Army Personnel Command Message Number 99-100 (with a Date/Time Group of 121605Z March 1999) authorized award of both the Armed Forces Service Medal and the Armed Forces Expeditionary Medal, as a one-time exception to Department of Defense and Service policy, for qualifying service in support of Operations Joint Endeavor and Joint Guard in the Republic of Bosnia-Herzegovina. This exception allowed both service medals to be presented to personnel deployed in Bosnia-Herzegovina, aboard naval vessels operating in the Adriatic Sea and their respective air spaces during the period 1 June 1992 to 19 December 1996 (Operation Joint Endeavor) and during the period 20 December 1996 to 20 June 1998 (Operation Joint Guard). The exception also allowed only one award of each service medal for service in either or both Operation Joint Endeavor and Operation Joint Guard.
CONCLUSIONS:
1. The applicant’s date of birth on his DD Form 214 is obviously incorrect. His date of birth as evidenced in his record and the document that he submits is 25 January 1972. His DD Form 214 should be changed accordingly.
2. The applicant received two awards of the Army Commendation Medal, the last just prior to his release from active duty. His DD Form 214 should reflect two awards of the Army Commendation Medal.
3. In requesting an award of a campaign badge, the applicant may well be referring to award of the Armed Forces Expeditionary Medal. He is entitled to that award.
4. In view of the foregoing, the applicant’s records should be corrected as recommended below.
RECOMMENDATION:
That all of the Department of the Army records related to this case be corrected by showing that the applicant was awarded the Army Commendation Medal with first oak leaf cluster and the Armed Forces Expeditionary Medal; and that his DD Form 214 be corrected by showing his date of birth as 25 January 1972.
